r INTRODUCED BY COUNCILMEMBER METCALFE BILL NO. 7579 ORDINANCE NO. 5375 x t AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, AND AS FURTHER AMENDED BY ORDINANCE NO. 5005, ENACTED OCTOBER 25, 1976, RELATING TO ZONING, BY REPEALING SECTION 34-38.3, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 34-38.3 PERMITTED USES," SO AS TO ADD COMMERCIAL AMUSEMENT LOCATIONS IN AN INDUSTRIAL COMMERCIAL DISTRICT; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. c WHEREAS, Chapter 34 of the Municipal Code of the City of University i City (University City Zoning Code) divides the City into several zoning districts, and regulates the uses to which the premises located therein may be } put; and WHEREAS, Section 34-38.3 thereof provides for permitted uses; and E WHEREAS, a public hearing was scheduled to be held at 8:00 P.M. , on the 21st day of March, 1983, in the Council Chamber at City Hall, concerning the addition of commercial amusement locations to Section 34-38.3 Permitted Uses; and WHEREAS, said public hearing was duly held and all suggestions or objections concerning said change in said Section were duly heard and considered i by the Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: F z Section 1. Chapter 34 of the Municipal Code of the City of University City, relating to Zoning is hereby amended by repealing Section 34-38.3 thereof, as amended by Ordinance No. 5005 enacted October 25, 1976, relating to Permitted s Uses and enacting in lieu thereof a new section to be known as "Section 34-38.3 f C Permitted Uses," by amending said section so as to add commercial amusement locations (less than 3 automatic coin-operated amusement machines) to Permitted Uses in an Industrial Commercial District, relating to the same subject and re- enacting said section so that said section as so amended, shall read as i follows: r 34-38.3 PERMITTED USES z Any structure or land in the "IC" industrial commercial district may be used for the production, processing, r assembly, fabrication, packaging, cleaning, servicing, test- ing, repair, display, storage and sales of materials, goods, or products; and for office activities and commercial amusement locations (less than 3 automatic coin-operated amusement machines), subject to all the provisions of the d University City Zoning Code and other applicable ordinances and statutes. Existing residential uses may be continued except that they shall not be expanded, enlarged, or increased in intensity. x s Es f
