INTRODUCED BY COUNCILMEMBER ADAMS <br /> BILL NO. 7634 ORDINANCE NO. 5426 <br /> AN ORDINANCE AUTHORIZING THE CITY MANAGER TO CONVEY AND GRANT TO <br /> DONALDSON COURTS ASSOC. , A QUIT CLAIM DEED FOR A CITY OWNED <br /> RIGHT-OF-WAY LOCATED BETWEEN DELMAR BOULEVARD AND ENRIGHT AVENUE <br /> ABUTTING THE ACKERT PARK RIGHT-OF-WAY, MORE FULLY DESCRIBED <br /> BELOW, FOR THE CONSIDERATION OF ONE DOLLAR ($1.00) ; AND DIRECTING <br /> THE CITY CLERK TO ATTACH THE SEAL OF THE CITY THERETO, AND <br /> CONTAINING AN EMERGENCY CLAUSE. <br /> WHEREAS, the City of University City has heretofore acquired the right-of-way <br /> abutting the Ackert Park right-of-way; and <br /> WHEREAS, Donaldson Courts Assoc. has offered to purchase said right-of-way for <br /> f <br /> ONE DOLLAR ($1.00); and <br /> E <br /> WHEREAS, it is in the best interest of the City of University City to convey <br /> to Donaldson Courts Assoc. a quit claim deed for said right-of-way. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, s <br /> 3 <br /> MISSOURI, AS FOLLOWS: <br /> Section 1. Within ten ( 10) days of Donaldson Courts Assoc. acquiring title to <br /> the abutting east property of the City owned right-of-way, the City Manager, on behalf <br /> of the City of University City, is hereby authorized to execute such documents as may <br /> be necessary to convey said property described in Section 2 hereof to Donaldson Courts <br /> F <br /> Assoc. <br /> Section 2. Said property so conveyed is described as follows: ` <br /> TRACT 3 <br /> A tract of land being part of property now or formerly of the <br /> City of UnivA ity City as shown on the plat recorded in plat book <br /> 19 page 4 of the St. Louis County Records and being more particu- <br /> larly described as: <br /> Beginning at a point in the West line of Block 2 of North Park- <br /> view, as recorded in plat book 19 page 4 of the St. Imiis County <br /> Records, at its intersection with the North line of Delmar Blvd. , <br /> 80 feet wide, thence Westwardly along the North line of Delmar Q <br /> Blvd. 45.00 feet to a point, thence Northwardly at a right angle <br /> 21.50 feet to a point, thence Westwardly at a right angle 20.75 <br /> feet to a point thence Northwardly at a right angle a distance of <br /> 258.50 feet to a point in the prologation of the centerline of <br /> Enright Avenue Vacated, thence Eastwardly along said centerline <br /> 27.35 feet to a point, thence Southwardly at a right angle 90.00 <br /> feet to a point, thence Westwardly at a right angle a distance of <br /> 25.00 feet to a point, thence along a curve to the left a <br /> distance of 99.00 feet to a point, thence Eastwardly along a <br /> radial line a distance of 25.00 feet to a point, thence along a <br /> curve to the left a distance of 1.67 feet to a point, thence <br /> along a curve to the right a dist ance of 102.79 feet to the <br /> point of beginning and containing 8939 sq. ft. <br /> Section 3.
