INTRODUCED BY COUNCILMEMBER ADAMS BILL N0. 7650 ORDINANCE NO. 5446 AN ORDINANCE RATIFYING AND CONFIRMING THAT THE DONALDSON REDEVELOPMENT AREA IS A BLIGHTED AREA; APPROVING THE DEVELOPMENT PLAN SUBMITTED ON BEHALF OF DONALDSON REDEVELOP- MENT CORPORATION; FINDING THAT SUCH DEVELOPMENT PLAN CONFORMS TO THE COMPREHENSIVE PLAN OF THE CITY; PROVIDING FOR TAX ABATEMENT IN ACCORDANCE WITH CHAPTER 353, REVISED STATUTES OF MISSOURI, 1978, AS AMENDED; INCORPORATING BY REFERENCE CHAPTER 353 REVISED STATUTES OF MISSOURI 1969, AS AMENDED; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR THE IMPLEMENTATION OF THE ORDINANCE e AND CONTAINING AN EMERGENCY CLAUSE. WHEREAS, Westminster Development Corporation, on behalf of Donaldson Redevelopment Corporation, a Missouri corporation, and Donaldson Court Associ- ates, a Missouri limited partnership (collectively , the. "Developer"), did on July 12, 1984, duly submit a proposed plan of development of the real estate descirbed in Exhibit A attached hereto and known as the Donaldson Redevelopment Area (the "Project Area"); and WHEREAS, thereafter the. City Plan Commission did make an independent study and investigation of said Development Plan and thereafter on July 25, 1984, did adopt a resolution approving said Development Plan, which resolution was duly transmitted to the Mayor and the. City Council on July 26, 1984; and WHEREAS, the City Plan Commission determined that the Development Plan is in the public interest and serves a public purpose; and WHEREAS, the City Council by Ordinance No. 5445 declared the Project Area to be blighted in the . manner- . described in Chapter 353 of the Revised Statutes of Missouri, 1978, as amended; and WHEREAS, the City Council. advertised in a newspaper of general circu- lation in the City of University City that a public hearing would be held by the City Council on the redevelopment- Plan and. said public hearing was held at the time and place designated in. said. no.tice, and all. those interested in being heard were given a reasonable opportunity to express their views. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1 . The City Council has reviewed the recommendation of the City Plan Commission -that the area. described in Exhibit A attached hereto (the "Project Area") is a blighted area, and the City Council hereby ratifies and confirms the finding in Ordinance No. 5445 to the effect that Project Area is a blighted area as defined by Chapter 353, Revised Statutes of Missouri, 1978, as amended.
