INTRODUCED BY COUNCILMEMBER LEVY < BILL NO. 7652 ORDINANCE NO. 5448 AN ORDINANCE AMENDING ORDINANCE NO. 5272 AS ENACTED ON JANUARY 5, 1981, RELATING TO THE TELEVISION FRANCHISE BY REPEALING ARTICLE III - SECTION 4(g) RATE CHANGE PROCEDURES; AND ENACTING IN LIEU THEREOF A NEW ARTICLE III, SECTION 4(g) TO BE KNOWN AS "ARTICLE III - SECTION 4(g) RATE CHANGE PROCEDURES," SO AS NOT TO REQUIRE A CERTIFICATION BY AN INDEPENDENT CERTIFIED PUBLIC ACCOUNTANT; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. WHEREAS, the City of University City, Missouri, has found it desirable and advantages to allow Continental Television Company of University City to not require certification by an independent Certified Public Accountant . BE IT ORDAINED BY THE COUNCIL OF THE *CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Ordinance No. 5272 as enacted on January 5, 1981, relating to the Cable Television Franchise is hereby amended by repealing Article III, Section 4(g) thereof relating to the Rate Change Procedures, and enacting in lieu thereof a new Article to be know as "Article III - Section 4(g) Rate Change Procedures," so as not to require a certification by an independent Certified Public Accountant, and re-enacting said Article so that said Article, as so amended shall read as follows: ARTICLE III. ADMINISTRATION AND REGULATION Section 4. Rate Change Procedures g) The Company's petition for a rate increase shall include, but not be limited to, the following financial reports, which shall reflect the operation of the University City system only: 1. Balance Sheet 2. Income Statement 3. Statement of Sources and Applications of Funds 4. Detailed Supporting Schedules of Expenses, Income Assets and other items as may be required 5. Statement of Current and Proposed Subscribers and Penetration c 6. Cash Flow Statements, Current and Projected The Company's accounting records applicable to the City of University City system shall be available for inspection by the City at all reasonable times. The City shall have access to records of financial transactions for the purpose of verifying burden rates or other indirect costs prorated to the University City operation. The documents listed above shall be prepared in accordance with gener- ally accepted accounting principles, and shall include sufficient detail and/or footnotes as may be necessary to provide the City with the information needed to make accurate determination as to the financial condition of the system. All financial statements shall be certified as accurate by an office of the Company. Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty heretofore incurred by the violation of Article III - Section 4(g), nor bar the prosecution for any such violation. Section 3. This ordinance shall take effect and be in force from and after its passage, as provided by law. PASSED this 24th day of September , 984.
