INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> BILL N0. 7660 ORDINANCE NO. 5456 <br /> AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE <br /> CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY REPEALING <br /> SECTION 34-36 .6c RELATING TO USE REGULATIONS, YARD AND SET- <br /> BACK REQUIREMENTS, AND ENACTING A NEW SECTION TO BE KNOWN AS <br /> SECTION 34-36 .6c BY AMENDING SAID SECTION SO AS TO DELETE THE <br /> PRESENT PROVISION AND SUBSTITUTE IN LIEU THEREOF THE AMENDED <br /> PROVISION. <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of University City <br /> (University City Zoning Code) divides the City into several zoning districts , and <br /> regulates the uses to which the premises located therein may be put; and <br /> WHEREAS, Section 34-36.6 provides for use regulations in a "RC" Retail <br /> Commercial District ; and <br /> s <br /> WHEREAS, the Zoning Administrator has forwarded to the Historic <br /> Preservation Commission a copy of the Plan Commission's recommended amendment of <br /> Sec. 34-36.6c of the Zoning Code, so that the Historic Preservation Commission may <br /> review such recommendations and appear at a public meeting to be held by the City <br /> Council November 12, 1984 , at 7:30 P.M. to present its views . <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br /> CITY, MISSOURI , AS FOLLOWS: <br /> Section 1 . Chapter 34 of the Municipal Code of the City of University <br /> City, Missouri, as enacted by Ordinance No. 5005, is hereby amended by repealing <br /> Section 34-36.6c, and enacting in lieu thereof a new section to be known as <br /> 34-36.6c, so as to read as follows: <br /> 34-36 6 c Yard and Setback Requirements: <br /> Minimum right-of-way setback: Thirty-five (35) feet . Exceptions: <br /> 1 . If no automobile parking spaces or driveways are located <br /> between the public right-of-way and any principal or accessory <br /> building, the minimum setback may be reduced to fifteen (15) <br /> feet . <br /> 2 . The setback requirement along Delmar Boulevard may be waived <br /> by the City Council after Site Plan Review. <br /> Minimum side or rear yard: None required ; but if a side or rear <br /> yard is provided , no such yard shall be less than five (5) feet in <br /> width. <br /> Section 2.
