BILL N0, 7672 INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> ORDINANCE N0. 5468 <br /> AN ORDINANCE AMENDING CHAPTER 23 OF THE MU <br /> OF THE CITY OF UNIVERSITY CITY, RELATING TO NICIPAL <br /> MISCELLANEOUS, BY REPEALING SECTION 23-10 AS ENACTED BY <br /> ORDINANCE NO. 4318 DATED DECEMBER 18, 1950, AND ENACT- <br /> ING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br /> "SECTION 23-10. DISTURBING THE PEACE," TO CONFORM THE <br /> SECTION TO THE NEW SECTION IN THE MISSOURI STATUTES, <br /> CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI <br /> AS FOLLOWS: ' <br /> Section 1• Chapter 23 of the t Municipal Code of the City y of University <br /> City, relating to Offenses - Miscellaneous <br /> enacted by Ordinance No. 4318 <br /> dated December 18, 1950, is hereby amended by enacting therein a new sec- <br /> tion to be known as, "Section 23-10. Disturbing the peace," to conform the <br /> section to the new section in the Missouri Statutes, relating to the same <br /> subject and re-enacting said section so that said section, as so amended <br /> shall read as follows: ' <br /> Sec. 23-10. Disturbing the peace <br /> A person commits the crime of disturbing the peace if: <br /> 1. He unreasonably and knowingly disturbs or alarms another <br /> person or persons by: <br /> (a) Loud noise; or <br /> (b) Offensive and indecent language which is likely to produce <br /> an immediate violent response from a reasonable recipient; or <br /> (c) Threatening to commit a crime against any person; or <br /> (d) Fighting; or <br /> (e) Creating a noxious and offensive odor. <br /> 2. He is in a public place or on private property of another <br /> without consent, and purposely causes inconvenience to another <br /> person or persons by unreasonably and physically obstructing: <br /> (a) Vehicular or pedestrian traffic; or <br /> (b) The free ingress or egress to or from a public or private place. <br /> Section 2. This ordinance shall not be construed so as to relieve any <br /> person, firm or corporation from any penalty heretofore incurred by the <br /> violation of Section 23.10 nor bar the prosecution for any such violation. <br /> Section 3. Any person, firm or corporation violating any of the <br /> visions of this ordinance, shall u Pro- <br /> . P on conviction thereof, be subject to <br /> the penalty provided in Chapter 1, Section 1-8 of the Municipal Code of the <br /> City of University City. <br /> Section 3.
