INTRODUCED BY COUNCILMEMBER ADAMS <br /> BILL NO. 7690 ORDINANCE NO. 5485 <br /> AN ORDINANCE FINDING THAT THE TRINITY/WASHINGTON/KINGSBURY REDEVELOPMENT AREA <br /> IS A BLIGHTED AREA; APPROVING THE DEVELOPMENT PLAN SUBMITTED ON BEHALF OF <br /> DELMAR MARKET REDEVELOPMENT CORPORATION; FINDING THAT SUCH DEVELOPMENT PLAN <br /> CONFORMS TO THE COMPREHENSIVE PLAN OF THE CITY; AUTHORIZING THE LAND <br /> CLEARANCE FOR REDEVELOPMENT AUTHORITY OF THE CITY OF UNIVERSITY CITY TO ENTER <br /> INTO A REDEVELOPMENT CONTRACT WITH DELMAR MARKET REDEVELOPMENT CORPORATION; <br /> PROVIDING FOR TAX ABATEMENT IN ACCORDANCE WITH CHAPTER 353, REVISED STATUTES <br /> OF MISSOURI , 1978, AS AMENDED; INCORPORATING BY REFERENCE CHAPTER 353 REVISED <br /> STATUTES OF MISSOURI 1978, AS AMENDED; AND CONTAINING AN EMERGENCY CLAUSE. <br /> WHEREAS, Delmar Market Redevelopment Corporation, a Missouri <br /> corporation, ("Developer") , did on May 14, 1985, duly submit a proposed plan <br /> of development (the "Development Plan") to the City Plan Commission for the <br /> development of the real estate described in Exhibit A attached hereto and <br /> known as the Trinity/Washington/Kingsbury Redevelopment Area (the "Project <br /> Area"). <br /> WHEREAS, thereafter the City Plan Commission did make an independent <br /> study and investigation of the Development Plan and thereafter on May 22, <br /> 1985, did adopt a resolution approving the Development Plan, which resolution <br /> was duly transmitted to the Mayor and the City Council on May 28 1985, <br /> and; <br /> WHEREAS, the City Plan Commission determined that the Development Plan <br /> is in the public interest and serves a public purpose; <br /> WHEREAS, the City Council advertised in a newspaper of general <br /> circulation in the City of University City that a public hearing would be <br /> held by the City Council on the Redevelopment Plan and said public hearing <br /> was held at the time and place designated in said notice and all those <br /> interested in being heard were given a reasonable opportunity to express <br /> their views; <br /> NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF. UNIVERSITY <br /> CITY AS FOLLOWS: <br /> s <br /> Section 1. The City Council has reviewed the recommendation of the City <br /> Plan Commission that the area described in Exhibit A attached hereto (the <br /> "Project Area") is a blighted area and the City Council hereby finds that the <br /> Project Area is a blighted area as defined by Chapter 353, Revised Statutes <br /> of Missouri , 1978, as amended, and Ordinance No. 5085 of the City of <br /> University City as amended by Ordinance No. 5165. <br /> Section 2. It is hereby declared that the Development Plan attached <br /> hereto as Exhibit B (the "Development Plan") is approved and adopted in <br /> accordance with the provisions of this Ordinance and that approval of the <br /> Development Plan and its implementation is necessary for the preservation of <br /> the health, safety, morals and welfare of the public. <br /> Section 3. It has been determined that there is no necessity to grant <br /> the power of eminent domain to the Developer. <br /> x <br /> Section 4. It has been determined that there will be no displacement of <br /> personsamilies by the Developer in connection with the development <br /> described in the Development Plan. <br /> Section 5. The City Manager and the Land Clearance for Redevelopment <br /> Authority the City of University City (the "Authority") shall be and are <br /> hereby authorized and directed to enter into and perform on behalf of the <br /> City a redevelopment contract with the Developer which contract shall contain <br />
