Nonconforming Use - An existing use of a structure or land <br /> which does not comply in some respect with the use regula- <br /> tions applicable to new uses in the zoning district in which <br /> it is located. <br /> Open Space (Usable.Residential Common Open Space) - Any out- <br /> door area .of such location, .size, and shape as to provide for <br /> specific outdoor living as patios, swimming pools, etc. , or <br /> outdoor service functions as laundry drying. Area considered <br /> as usable common open space must be available for all <br /> residential occupants of a given building or project and may <br /> include only those spaces enclosing .an area of at least three <br /> hundred (300) square feet, and measuring fifteen (15) feet in <br /> width at the narrowest point. <br /> Parking Space - cf. Section 34-50,3. <br /> Patio House - One of a series._. of one-story, basically <br /> L-shaped, single family residential. Awellings which, together <br /> with an enclosed private court.y:ard_ or patio, may occupy up <br /> to one hundred (100) percent of a subdivided lot. The court- <br /> yard or patio of such a house serves as the principal open <br /> space and source of natural light for the occupants. <br /> Performance standard - A criterion established to control <br /> noise, smoke, toxic or noxious matter, vibration, fire and <br /> explosive hazards, and glare and heat generated by or <br /> inherent in the use of land or buildings, (Section 34-39.7) . <br /> Person - A corporation, firm, partnership, association, <br /> organization and any other group .acting as a unit as well as <br /> individuals. It shall _ also include an executor, adminis- <br /> trator, trustee, receiver, or other representative appointed <br /> according to law. Whenever the word "person" is used in any <br /> section of this Chapter. prescribing a penalty or fine as to <br /> partnership or association, the word shall include the <br /> partners or members thereof, and, as to corporation, it shall <br /> include the officer, agents or members thereof who are <br /> responsible for any violation of such section. <br /> Principal Building - The structure in which the principal use <br /> on the lot is located. <br /> Private Passenger Vehicle - Any motor vehicle or motorcycle, <br /> other than a commercial vehicle, which does not exceed six <br /> and one-half (6-1/2) feet in height and is licensed as a <br /> passenger automobile or motorcycle. <br /> Project (Development) - One or more buildings on a single <br /> lot, or a group of buildings to be constructed by a single <br /> developer to be later sold individually on separate sub- <br /> divided lots of record. <br /> Public Service Drive - A public or private way, at the rear <br /> or side of property, primarily used as a means of secondary <br /> vehicular access to abutting property. <br /> Restaurants - A public eating place other than a drive-in or <br /> carry-out restaurant, and which does not offer goods or <br /> services to consumers waiting in parked motor vehicles. <br /> Row House - cf.
