upon which the Developer acquires the aforementioned real property, but also are applicable to the successors and/or assigns of Developer, provided such successors and/or assigns of the aforementioned real property shall continue to use, operate and maintain the aforementioned real property, in accordance with the provisions of the Development Plan, incorporated herein. Section 13. The sections of this ordinance shall be severable. In the event any section of this ordinance is found by a Court of competent jurisdiction to be unconstitutional, the remaining sections of this ordinance are valid unless the Court finds the valid sections of this ordinance are so essentially and inseparably connected with, and so dependent upon the void section that it cannot be presumed that the Council would have enacted the valid sections without the void ones, or unless the Court finds that the valid section standing alone are incomplete and are incapable of being executed in accordance with the legislative intent. If any part of this ordinance regarding the rights or duties herein of the Developer, its successors or assigns, are found invalid or unconstitutional, Developer, its successors or assigns, shall hereafter, at its election, have the right to be released from the contract contained herein. Section 14. This Ordinance being necessary for the immediate preser- vation of the public health, welfare and safety; it is hereby declared to be an emergency measure within the meaning of the Charter of the City of University City and shall become effective immediately upon its passage.
