upon which the Developer acquires the aforementioned real property, but also are <br /> applicable to the successors and/or assigns of Developer, provided such <br /> successors and/or assigns of the aforementioned real property shall continue to <br /> use, operate and maintain the aforementioned real property, in accordance with <br /> the provisions of the Development Plan, incorporated herein. <br /> Section 13. The sections of this ordinance shall be severable. In the <br /> event any section of this ordinance is found by a Court of competent jurisdiction <br /> to be unconstitutional, the remaining sections of this ordinance are valid unless <br /> the Court finds the valid sections of this ordinance are so essentially and <br /> inseparably connected with, and so dependent upon the void section that it cannot <br /> be presumed that the Council would have enacted the valid sections without the <br /> void ones, or unless the Court finds that the valid section standing alone are <br /> incomplete and are incapable of being executed in accordance with the legislative <br /> intent. If any part of this ordinance regarding the rights or duties herein of <br /> the Developer, its successors or assigns, are found invalid or unconstitutional, <br /> Developer, its successors or assigns, shall hereafter, at its election, have the <br /> right to be released from the contract contained herein. <br /> Section 14.
