INTRODUCED BY COUNCILMEMBER SCHOOMER BILL NO. 7722 ORDINANCE NO. 5518 AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO ZONING, BY REPEAL- ING SECTION 34-36.6c, AND ENACTING THEREIN A NEW SECTION TO BE KNOWN AS SECTION 34-36.6c BY AMENDING THE EXCEPTIONS TO THE MINIMUM RIGHT-OF-WAY SETBACK; CONTAINING A SAVING CLAUSE, AND PROVIDING A PENALTY. WHEREAS, Chapter 34 of the Municipal Code of the City of University City (University City Zoning Code) divides the City into several zoning districts, and regulates the uses to which the premises located therein may be put; and WHEREAS, Section 34-36.6c thereof provides for Yard and Setback Require- ments; and WHEREAS, the City Plan Commission, after a hearing, reviewed said section; and WHEREAS, due notice of a public hearing to be held by the City Council in the Council Chamber at City Fall, at 7:30 P.M. on the 27th day of January, 1986, was duly' published in the St. Louis Countian, a newspaper of general circulation r within said City; and WHEREAS, said public hearing was duly held, and all suggestions or objections concerning said change in said Section were duly heard and considered by the Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, is hereby amended by repealing Section 34-36.6c, and enacting therein a new "Section 34-36.6c Yard and Setback Requirements", as so amended, shall read as follows: c. Yard and Setback Requirements: Minimum right-of-way setback: Thirty-five (35) feet, except if no automobile parking spaces or driveways are located between the public right-of-way and any principal or accessory build- ing, the minimum setback may be reduced to fifteen (15) feet. This setback requirement may be waived by the City Council by conditional use permit or site plan review as provided in Section 34-65 or 34-69. Minimum side or rear yard: None required; but if a side or rear yard is provided, no such yard shall be less than five (5) feet in width. Section 2. Except for the change herein made, said Chapter 34 of the Municipal Code of University City (the University City Zoning Code) shall remain in full force and effect, and all the provisions, conditions, restrictions and s regulation therein shall be in full force and effect.
