INTRODUCED BY COUNCILMEMBER ADAMS <br /> BILL NO. 7737 ORDINANCE NO. 5533 _ <br /> AN ORDINANCE AMENDING CHAPTER 23 OF THE MUNICIPAL CODE OF . <br /> THE CITY OF UNIVERSITY CITY, RELATING TO OFFENSES - <br /> MISCELLANEOUS BY REPEALING SECTION 23-6 THEREOF, RELATING <br /> TO DAMAGING PUBLIC PROPERTY-GENERALLY, AND ENACTING IN <br /> LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 23-6. <br /> DAMAGING .PUBLIC PROPERTY-GENERALLY"; CONTAINING A SAVING <br /> CLAUSE AND PROVIDIING A PENALTY. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br /> MISSOURI, AS FOLLOWS: <br /> Section 1. Chapter 23 of the Municipal Code of the City of <br /> University City relating to Offenses - Miscellaneous is hereby amended by <br /> repealing Section 23-6 thereof, relating to damaging public property-Generally <br /> and enacting in lieu thereof a new section to be known as "Section 23-6. <br /> Damaging public property-Generally," relating to the same subject, and re- <br /> enacting said section so that said section, as so amended, shall read as <br /> follows: <br /> Sec. 23-6. Damaging public property-Generally. <br /> It shall be unlawful for any person to disfigure, damage <br /> or in anywise injure or destroy either in whole or any <br /> part thereof any statue, pedestal, gate, gatepost, <br /> fountain, lamppost, signpost, shade tree, hedgerow, <br /> shrubbery, bed of flowers, grass lawn, steps, curbing, <br /> sidewalk, fireplug, hydrant, telephone pole, telegraph <br /> pole, electric light pole or any other useful or orna- <br /> mental public property or fixture in any public street, <br /> alley, avenue, square, plaza or park or public school <br /> grounds in the City. <br /> Section 2. This ordinance shall not be construed so as to relieve <br /> any person, firm or corporation from any penalty heretofore incurred by the <br /> violation of Section 23-6, nor bar the prosecution for any such violation. <br /> Section 3. Any person, firm or corporation violating any of the <br /> provisions of this ordinance, shall, upon conviction thereof, be subject to <br /> the penalty provided in Chapter 1, Section 1-8 of the Municipal Code of the <br /> City of University City. <br /> Section 4.
