INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> BILL NO. 7738 ORDINANCE NO. 5534 <br /> AN ORDINANCE AMENDING CHAPTER 23 OF THE MUNICIPAL CODE OF <br /> THE CITY OF UNIVERSITY CITY, RELATING TO OFFENSES - <br /> MISCELLANEOUS BY REPEALING SECTION 23-8 THEREOF, RELATING <br /> TO DAMAGING, TRESPASSING OR ENTERING UPON THE PREMISES OF <br /> THE CITY WITHOUT LAWFUL AUTHORITY, AND ENACTING IN LIEU <br /> THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 23-8. <br /> DAMAGING, TRESPASSING OR ENTERING UPON THE PREMISES OF THE <br /> CITY WITHOUT LAWFUL AUTHORITY";. CONTAINING A SAVING CLAUSE <br /> AND PROVIDING A PENALTY. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br /> MISSOURI, AS FOLLOWS: <br /> Section 1. Chapter 23 of the Municipal Code of the City of <br /> University City relating to Offenses - Miscellaneous is hereby amended by <br /> repealing Section 23-8 thereof, relating to damaging, trespassing or entering <br /> z <br /> upon the premises of the City without lawful authority, and enacting in lieu <br /> thereof a new section to be known as "Section 23-8. Damaging, trespassing or <br /> entering upon the premises of the City without lawful authority," relating to <br /> the same subject, and re-enacting said section so that said section, as so t <br /> amended, shall read as follows: <br /> Sec. 23-8. Damaging, trespassing or entering upon the <br /> premises of the City without lawful authority. <br /> It shall be unlawful for any person to damage any property <br /> belonging to the City, or without lawful authority, enter <br /> upon, commit waste, trespass or other injury upon any <br /> premises, land, public park, building or other property of <br /> the City without the express or implied consent of the r <br /> City, its duly authorized agent or representative, or, j <br /> being upon the premises, land, property or building of the <br /> City, to fail or refuse to leave the same when requested <br /> to do so by one having lawful possession thereof of <br /> authority thereover. <br /> Section 2. This ordinance shall not be construed so as to relieve <br /> any person, firm or corporation from any penalty heretofore incurred by the <br /> violation of Section 23-8, nor bar the prosecution for any such violation. <br /> Section 3. Any person, firm or corporation violating any of the <br /> provisions of this ordinance, shall, upon conviction thereof, be subject to <br /> the penalty provided in Chapter 1, Section 1-8 of the Municipal Code of the <br /> City of University City. <br /> Section 4.
