INTRODUCED BY COUNCILMEMBER WAGNER BILL NO. 7743 ORDINANCE NO. 5539 AN ORDINANCE AMENDING ORDINANCE NO. 5508, ENACTED NOVEMBER 4, 1985, BY ENACTING IN LIEU THEREOF AN ORDINANCE AUTHORIZ- ING THE CITY MANAGER TO AMEND THE CONTRACT ON BEHALF OF THE CITY WITH THE DEVELOPER; CONTAINING AN EMERGENCY CLAUSE. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Ordinance No. 5508, enacted November 4, 1985, authorizing the City Manager to enter into a contract, on behalf of the City, with the Developer, is hereby amended so as to authorize the City Manager to amend, on behalf of the City, the contract between the City and the Developer and its successors and assigns within fifteen (15) days of the passage of this ordinance. Section 2. The form of said amended contract shall substantially be as follows: AMENDED AGREEMENT An amended Agreement entered into this day of , 19 , between the City of Univer.si.ty City, hereinafter referred to as "City", and the Trinity/Delmar Redevelopment Corporation, its subsidiaries, its successors, and assigns, hereinafter referred to as "Developer" for the execution of the Development Plan heretofore. submitt.ed by the Developer, approved and enacted by the City Council of the City of University City by the ordinance of which this amended Agreement is a part. NOW, THEREFORE, the City and the Developer, its successors and assigns, for the consideration and mutual covenants hereinafter contained and described under the conditions hereinafter set forth do hereby agree as follows: I. The provisions of the Urban Redevelopment Corporation Law, Chapter 353, Revised Statutes of Missouri, 1978, . as amended, up .to and including the date of this contract and the provisions of the ordinance of which this Agreement is a part and the Development, Plan, as amended, -are _hereby incorporated by reference and made in whole a part of. this Agr-eement.. Wherever the term "Development Plan" is used in this Agreement, it shall ref er__to_the-Development Plan incorporated by reference_ into Ordinance No. 5508, together with amendments and modifications, if any hereto. 2. Developer, .its. successors or. assigns, shall rehabilitate or cause to be rehabilitated, at its expense, the facilities. -more fully set out and described. in. the_Developme.nt Plan., and. in. the manner therein provided.
