VII Possession of concealable firearm unlawful for certain persons:-- <br /> A person commits the crime of unlawful possession of a concealable <br /> firearm if he has any concealable firearm in his possession and. <br /> (1) He has pled guilty to or has been convicted of a <br /> dangerous felony, as defined in section 556.061, RSMo, or of <br /> an attempt to commit a dangerous felony, or of a crime under <br /> the laws of any state or of the United States which, if <br /> committed within this state, would be a dangerous felony, or <br /> confined therefor in this state or elsewhere during the five- <br /> year period immediately preceding the date of such <br /> possession; or <br /> (2) He is a fugitive from justice, is habitually in an <br /> intoxicated or drugged condition, or is currently adjudged <br /> mentally incompetent. <br /> Section 2. Validity: If any section, subsection, paragraph, <br /> sentence, clause or phrase of Section 23-36 shall be declared invalid for any <br /> reason whatsoever, such decision shall_ not affect the remaining portions of <br /> Section 23-36 which shall. continue in full force and effect, and to this end <br /> the provisions of Section 23-.36 are hereby declared to be severable, <br /> Section 3. This ordinance shall not be construed so as to relieve <br /> any person, firm or corporation from any penalty heretofore incurred by the <br /> violation of Sections 23. 36, 23-37 or 23-37 .1, nor bar the prosecution for <br /> any such violation <br /> Section 4 i%iii pc-.rson, firm or corporation violating any of the <br /> provisions of this ordinance, shall, upon conviction thereof. be subject to <br /> the penalty provided in Chapter 1 , Section 1 .8 of the Municipal Code of the <br /> City of University C.i_,_y. <br /> Section 5 This Ordinance shall take effect. and be in for-e from <br /> and after its passage as provided by law. <br /> PASSED thiF 21st day of July 1986 <br /> MAYOR <br /> '�1TEST: <br /> CITY CLERK <br /> CERTIFIED TO BE CORRECT AS TO FORM: <br /> CITY AT NEY <br /> 5 <br />
