INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> BILL N0. 7765 ORDINANCE N0. 5561 <br /> AN ORDINANCE AMENDING CHAPTER 5 OF THE MUNICIPAL CODE OF THE CITY <br /> OF UNIVERSITY CITY, RELATING TO ANIMALS AND FOWL BY REPEALING SEC- <br /> TION 5-2.1 THEREOF AS AMENDED BY ORDINANCE NO. 4777, ENACTED MARCH <br /> 26, 1973, RELATING TO THE KEEPING OF MORE THAN TWO ANIMALS UNDER <br /> CERTAIN CONDITIONS, AND ENACTING IN LIEU THEREOF .A. NEW SECTION TO <br /> BE KNOWN AS "SECTION 5-2.1. KEEPING MORE THAN TWO ANIMALS UNDER <br /> CERTAIN CONDITIONS UNLAWFUL"; CONTAINING A SAVING CLAUSE, AN <br /> EMERGENCY CLAUSE AND PROVIDING A PENALTY. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS <br /> FOLLOWS: <br /> Section 1. Chapter 5 of the Municipal Code of the City of University <br /> City, relating to animals and fowl is hereby amended by repealing Section 5-2.1 s <br /> thereof, as amended by Ordinance No. 4777, enacted March 26, 1973, relating to keep- <br /> ing of more than two animals under certain conditions and enacting in lieu thereof a <br /> new section to be known as "Section 5-2.1. Keeping more than two animals under <br /> certain conditions unlawful", relating to the same subject, and re-enacting said <br /> section so that said section, as so amended, shall read as follows: <br /> Sec. 5-2.1. Keeping more than two animals under certain <br /> conditions unlawful. <br /> Y <br /> It shall be unlawful for any person to keep, maintain, or allow to <br /> remain on any one lot, tract or parcel of ground within the City <br /> more than two animals of the following types or any combination <br /> thereof: Dogs, cats, monkeys, ducks or pet birds, as provided for <br /> in Section 5-2; excluding, however, the young of a litter of <br /> animals under three months of age; it shall further be unlawful <br /> for any person to keep more than one such pet per dwelling unit in <br /> multiple family buildings of three units or more; provided, how- <br /> ever, this section shall not apply where such animals are kept in <br /> the conduct of a commerical enterprise or business at locations <br /> where such a business is permitted and duly licensed under Chapter <br /> 18 of this Code. <br /> F <br /> Section 2. This ordinance shall not be construed so as to relieve any <br /> person, firm or corporation from any penalty heretofore incurred by the violation of <br /> Section 5-2.1, nor bar the prosecution for any such violation. <br /> Section 3. Any person, firm or corporation violating any of the provisions <br /> of this ordinance, shall, 'upon conviction thereof, be subject to the penalty pro- <br /> vided in Chapter 1,Section 1-8 of the Municipal Code of the City of University City. <br /> Section 4.
