(7) (a) There shall be paid upon the death of any active <br /> employee a funeral benefit in the sum equal to one <br /> t <br /> month's base salary then in effect. <br /> (b) There shall be paid upon the death of an employee <br /> retired under Section 25-14(1) , 25-14(2) , 25-14(3) , <br /> 25-14(5) 25-15 or 25-16 a funeral benefit in the sum <br /> equal to one month's base salary in effect at the date <br /> the employee retired. <br /> (8) There shall be paid upon the death of any employee retired <br /> under Section 25-14(1) or Section 25-15 or upon service- <br /> connected death as provided in Section 25-15, the following: <br /> (a) To the employee's surviving spouse, provided such <br /> employee shall have been married to said surviving <br /> spouse prior to the employee's injury under Section 25- <br /> 15 or three years or more prior to the employee's <br /> retirement under Section 25-14(1) a monthly benefit of <br /> twenty-five percent (25%) of the monthly base salary in <br /> effect at the date of the employee's retirement or at <br /> the employee's death if not retired, from and after the <br /> date of such employee's death until the death or <br /> remarriage of such surviving spouse; but such surviving <br /> spouse's benefits shall not be less than one hundred <br /> dollars ($100.00) per month. <br /> (b) To the lawful guardian of such employee's surviving <br /> minor unmarried child or children under the age of <br /> eighteen years,' provided such child or children shall <br /> have been born within ten months after the employee's <br /> retirement or the employee's death in service, a <br /> monthly benefit of ten percent (10%) of the monthly <br /> base salary as previously described for such child or <br /> children until such child or children attain the age of <br /> eighteen years or marry; provided, the combined monthly <br /> payments to such surviving spouse and children shall in <br /> no case exceed sixty percent (60%) of the monthly base <br /> salary, and in which event the thirty-five percent <br /> (35%) maximum benefit for the eligible children shall <br /> be prorated between them; provided, further, that if <br /> there is no surviving spouse entitled to benefits in <br /> any month, the surviving spouse's benefit will be <br /> divided equally among the then eligible children, but <br /> no child shall be entitled to more than fifty percent <br /> (50%) of the surviving spouse's benefit. <br /> (9) There shall be paid upon the death of any employee retired <br /> under Section 25-16 or upon non-service connected death prior <br /> to retirement under Section 25-16, benefits which are seventy- <br /> five percent (75%) of the benefits provided by Section 25-21(7) <br /> except that the combined children's benefit shall not exceed <br /> thirty-one and one-fourth percent (31 1/4%) of the monthly base <br /> salary; provided, however, that upon the death of any employee <br /> who is eligible for retirement but who has not yet retired, the <br /> benefits shall be the same as are provided in Section 25-21(7) <br /> and the percentage limitations herein set forth shall not <br /> apply. <br /> (10) There shall be paid upon the death of any employee retired <br /> under Section 25-14(2) or Section 25-14(3) , a monthly benefit <br /> which bears the same ratio to the benefits provided in Section <br /> 25-21(8) as the monthly benefit received by the employee bears <br /> to one-half of the base monthly salary in effect at date of <br /> retirement; but such surviving spouse's benefits shall not be <br /> less than One Hundred Dollars ($100.00) per month. <br /> 3 <br />
