INTRODUCED BY COUNCILMEMBER PRICE BILL N0. 7773 ORDINANCE NO. 5569 AN ORDINANCE PROVIDING FOR THE CREATION, BUILDING AND ESTABLISHMENT OF A PUBLIC STREET LINKING DELMAR BOULEVARD AND BARBY LANE; TAKING, APPROPRIATING AND CONDEMNING PRIVATE PROPERTY THEREFOR, AND DIRECTING THE INSTITUTION OF A SUIT IN CONDEMNATION IN THE CIRCUIT COURT OF ST. LOUIS COUNTY, MISSOURI FOR SAID PURPOSE. WHEREAS, the Council is of the opinion that a public street link- ing Delmar Boulevard and Barby Lane is in the public interest and is necessary and advisable in order to promote the public welfare of the inhabitants of University City; and WHEREAS, it is necessary and appropriate to acquire the following described property by condemnation for said purpose. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. For the purpose of creating, building and establishing a public street linking Delmar Boulevard and Barby Lane, it is necessary to acquire by condemnation proceedings certain private property, and for that purpose the following property and every estate and interest therein is hereby taken, appropriated and condemned, to wit: The property located at 8635 Barby Lane is recorded on Deed 4123 filed on January 13, 1959, at 11:33 in Book 4026, Page 372. The property described on this Deed as being Lot (6) of Barby Lane, a subdivision in St. Louis County, Missouri, as per Plat Book 61, Page 30, of the St. Louis County Records. The property of Lot (6) , Barby Lane Subdivision is con- tained within the following boundaries: Starting at a point of reference located at the point of intersection of the north right-of-way line of Barby Lane (50 feet wide), a street of Barby Lane Subdivision in Univerity City, Missouri, and the west boundary line of a 3 feet wide easement described in City of St. Louis Ordinance No. N244049 passed April 7, 1947, and Uni- versity City Ordinance No. 2877 passed June 2, 1947, and filed in Book 2291, Page 302, on August 7, 1947. Then going westwardly along said north right-of-way line of Barby Lane (50 feet wide) for a distance of 368.21 feet to the point of intersection of the east boundary line of Lot 6 and said north right-of-way line of Barby Lane (50 feet wide). This point of intersection is the point of beginning of the boundary description of Lot 6 in Barby Lane Subdivision. Starting at said point of beginning and going 65 feet westwardly along the north right-of-way line of Barby Lane (50 feet wide) which is also the south boundary line of Lot 6 to the point of intersection of the west boundary line of Lot 6 and said south boundary line of Lot 6. Then turning 900 northwardly and going 180 feet along said west boundary
