INTRODUCED BY COUNCILMEMBER PRICE <br /> BILL NO. 7774 ORDINANCE NO. 5570 <br /> AN ORDINANCE ACCEPTING THE COMPLETED WORK OF THE IMPROVEMENT <br /> OF LIBERTY AVENUE, A PUBLIC STREET IN THE CITY OF UNIVERSITY <br /> CITY, MISSOURI, EXTENDING FROM HARRISON AVENUE TO LAMB <br /> AVENUE, DESIGNATED AS PROJECT NO. 789, AND PAYING THEREFOR <br /> PARTIALLY BY LEVYING A SPECIAL ASSESSMENT OR TAX AGAINST THE <br /> ABUTTING PROPERTY IN THE NAME OR NAMES OF THE OWNER OR <br /> OWNERS THEREOF AND AUTHORIZING THE ISSUANCE OF SPECIAL TAX <br /> BILLS THEREFOR, AND PARTIALLY IN CASH BY THE CITY OF <br /> UNIVERSITY CITY, MISSOURI, OUT OF AVAILABLE CITY FUNDS, ALL <br /> IN ACCORDANCE WITH THE PROPERLY ADVERTISED RESOLUTION <br /> ADOPTED BY THE COUNCIL OF SAID CITY ON THE SEVENTH DAY OF <br /> OCTOBER, 1985, AND UNDER PROVISIONS OF ORDINANCE NO 5532, <br /> PASSED THE NINETEENTH DAY OF MAY, 1986, AND THE CONTRACT <br /> ENTERED INTO PURSUANT THERETO AND THE COUNCIL FOUND AND <br /> DECLARED IT NECESSARY THAT THE IMPROVEMENT BE MADE. <br /> WHEREAS, the Council of the City of University City, Missouri, did <br /> adopt a resolution on the 7th day of October, 1985, for the work of improving <br /> Liberty Avenue extending from Harrison Avenue to Lamb Avenue a distance of <br /> approximately Seven Hundred (700) feet, in the City of University City, <br /> 4 <br /> Missouri, and setting forth the estimated "Whole Cost" thereof, which cost <br /> included the expenses estimated to be incurred by the City for surveys, plans, <br /> supervision, engineering services and all other City expenses necessary to <br /> complete the work satisfactorily; said "Whole Cost" to be paid for partially { <br /> ¢i <br /> by a special assessment or tax against the abutting property in the name or <br /> names of the owner or owners thereof within the limits of the benefit district <br /> and partially in cash by the City of University City, Missouri, out of availa- <br /> ble City funds; that the said special tax bills evidencing such assessment be <br /> issued to the contractor in payment for the tax bill portion of said work, and <br /> fixing a date for public hearing thereon; and <br /> WHEREAS, notice of said public hearing was published in the St. f <br /> Louis Countian, a newspaper of general circulation published in St. Louis <br /> County, Missouri, on the 15th day of October, 1985, providing that said public <br /> hearing be held on the 21st day of October, 1985; and <br /> WHEREAS, said public hearing was duly held on the 21st day of <br /> October, 1985, and all suggestions or objections concerning said improvement <br /> were duly heard and considered by the Council and the Council thereafter <br /> K <br /> directed the City Manager to cause plans, specifications and detailed esti- <br /> mates of cost for the proposed improvement to be prepared and submitted to the <br /> City Council for approval; and <br />
