INTRODUCED BY COUNCILMEMBER PRICE BILL NO. 7783 ORDINANCE NO. 5579 AN ORDINANCE TO AMEND ORDINANCE NO. 5569 ENTITLED "AN ORDINANCE PROVIDING FOR THE CREATION, BUILDING AND ESTABLISHMENT OF A PUBLIC STREET LINKING DELMAR BOULE- VARD AND BARBY LANE; TAKING, APPROPRIATING AND CONDEMNING PRIVATE PROPERTY THEREFOR, AND DIRECTING THE INSTITUTION OF A SUIT IN CONDEMNATION IN THE CIRCUIT COURT OF ST. LOUIS COUNTY, MISSOURI, FOR SAID PURPOSE," IN ORDER TO CORRECT CERTAIN FIGURES IN THE MEASUREMENT OF THE PROPERTY TO BE TAKEN, APPROPRIATED AND CONDEMNED IN SAID ORDINANCE. WHEREAS, the Council desires to amend Ordinance No. 5569 entitled "An ordinance providing for the creation, building and establishment of a public street linking Delmar Boulevard and Barby Lane; taking, appropriating It and condemning private property therefor, and directing the institution of a suit in condemnation in the Circuit Court of St. Louis County, Missouri, for s said purpose," in order to correct certain figures in the measurement of the t property to be taken, appropriated and condemned. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF i UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. For the purpose of creating, building and establishing a public street linking Delmar Boulevard and Barby Lane, it is necessary to acquire by condemnation proceedings certain private property, and for that purpose the following property and every estate and interest therein is hereby taken, appropriated and condemned, to wit: The property located at 8635 Barby Lane is recorded on Deed #123 filed on January 13, 1959, at 11:33 in Book z' 4026, Page 372. The property described on this Deed as being Lot (6/) of Barby Lane, a subdivision in St. Louis County, Missouri, as per Plat Book 61, Page 30, of the St. Louis County Records. The property of Lot (6) , Barby Lane Subdivision is con- x S tained within the following boundaries: Starting at a point of reference located at the point of intersection of the north right-of-way line of Barby Lane (50 feet wide) , a street of Barby Lane Subdivision in Univerity City, Missouri, and the west boundary line of a 3 feet wide easement described in City of St. Louis Ordinance No. N244049 passed April 7, 1947, and Uni- versity City Ordinance No'. 2877 passed June 2, 1947, and filed in Book 2291, Page 302, on August 7, 1947. Then going westwardly along said north right-of-way line of Barby Lane (50 feet wide) for a distance of 368.21 feet to the point of intersection of the east boundary line of Lot 6 and said north right-of-way line of Barby Lane (50 feet wide) . This point of intersection is the point of beginning of the boundary description of Lot 6 in Barby Lane Subdivision.
