INTRODUCED BY COUNCILMEMBER PRICE <br /> BILL NO. 7783 ORDINANCE NO. 5579 <br /> AN ORDINANCE TO AMEND ORDINANCE NO. 5569 ENTITLED "AN <br /> ORDINANCE PROVIDING FOR THE CREATION, BUILDING AND <br /> ESTABLISHMENT OF A PUBLIC STREET LINKING DELMAR BOULE- <br /> VARD AND BARBY LANE; TAKING, APPROPRIATING AND <br /> CONDEMNING PRIVATE PROPERTY THEREFOR, AND DIRECTING THE <br /> INSTITUTION OF A SUIT IN CONDEMNATION IN THE CIRCUIT <br /> COURT OF ST. LOUIS COUNTY, MISSOURI, FOR SAID PURPOSE," <br /> IN ORDER TO CORRECT CERTAIN FIGURES IN THE MEASUREMENT <br /> OF THE PROPERTY TO BE TAKEN, APPROPRIATED AND CONDEMNED <br /> IN SAID ORDINANCE. <br /> WHEREAS, the Council desires to amend Ordinance No. 5569 entitled <br /> "An ordinance providing for the creation, building and establishment of a <br /> public street linking Delmar Boulevard and Barby Lane; taking, appropriating <br /> It <br /> and condemning private property therefor, and directing the institution of a <br /> suit in condemnation in the Circuit Court of St. Louis County, Missouri, for <br /> s <br /> said purpose," in order to correct certain figures in the measurement of the <br /> t <br /> property to be taken, appropriated and condemned. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> i <br /> UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> Section 1. For the purpose of creating, building and establishing <br /> a public street linking Delmar Boulevard and Barby Lane, it is necessary to <br /> acquire by condemnation proceedings certain private property, and for that <br /> purpose the following property and every estate and interest therein is <br /> hereby taken, appropriated and condemned, to wit: <br /> The property located at 8635 Barby Lane is recorded on <br /> Deed #123 filed on January 13, 1959, at 11:33 in Book z' <br /> 4026, Page 372. The property described on this Deed as <br /> being Lot (6/) of Barby Lane, a subdivision in St. Louis <br /> County, Missouri, as per Plat Book 61, Page 30, of the <br /> St. Louis County Records. <br /> The property of Lot (6) , Barby Lane Subdivision is con- x <br /> S <br /> tained within the following boundaries: <br /> Starting at a point of reference located at the point of <br /> intersection of the north right-of-way line of Barby <br /> Lane (50 feet wide) , a street of Barby Lane Subdivision <br /> in Univerity City, Missouri, and the west boundary line <br /> of a 3 feet wide easement described in City of St. Louis <br /> Ordinance No. N244049 passed April 7, 1947, and Uni- <br /> versity City Ordinance No'. 2877 passed June 2, 1947, and <br /> filed in Book 2291, Page 302, on August 7, 1947. Then <br /> going westwardly along said north right-of-way line of <br /> Barby Lane (50 feet wide) for a distance of 368.21 feet <br /> to the point of intersection of the east boundary line <br /> of Lot 6 and said north right-of-way line of Barby Lane <br /> (50 feet wide) . This point of intersection is the point <br /> of beginning of the boundary description of Lot 6 in <br /> Barby Lane Subdivision. Starting at said point of <br /> beginning and going 65 feet westwardly along the north <br /> right-of-way line of Barby Lane (50 feet wide) which is <br /> also the south boundary line of Lot 6 to the point of <br /> z <br /> E <br /> 7 <br /> t <br />
