INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> BILL NO. 7784 ORDINANCE NO. 5580 <br />' t <br /> AN ORDINANCE MODIFYING THE DEVELOPMENT PLAN FOR THE PARK- <br /> VIEW GARDENS REHABILITATION AREA AS INITIALLY APPROVED BY <br /> ORDINANCE NO. 5450 OF THE CITY OF UNIVERSITY CITY; THAT A <br /> CERTAIN AREA IN THE CITY OF UNIVERSITY CITY GENERALLY <br /> BOUNDED BY OLIVE BOULEVARD ON THE NORTH, THE CITY LIMITS <br /> ON THE EAST, WASHINGTON AVENUE ON THE SOUTH AND KINGSLAND <br /> ON THE [JEST IS BLIGHTED AS DEFINED IN ORDINANCE NO. 5085 <br /> OF THE CITY OF UNIVERSITY CITY AND IN SECTION 353.020(2) <br /> R.S.MO. 1978 AS AMENDED; THAT THE REDEVELOPMENT OF SUCH <br /> AREA IS NECESSARY IN THE PUBLIC INTEREST UNDER CHAPTER <br /> 353 OF THE REVISED STATUTES OF MISSOURI AND IS IN THE <br /> INTEREST OF PUBLIC HEALTH, SAFETY, MORALS AND GENERAL <br /> WELFARE OF THE PEOPLE OF THE CITY OF UNIVERSITY CITY; <br /> APPROVING THE MODIFIED DEVELOPMENT PLAN SUBMITTED BY <br /> UNIVERSITY CITY REDEVELOPMENT CORPORATION FOR THE PROJECT <br /> AREA; GRANTING A CERTIFICATE OF CONVENIENCE AND NECESSITY <br /> TO SAID CORPORATION TO EXERCISE THE POWER OF EMINENT <br /> DOMAIN; AUTHORIZING A CONTRACT AMONG THE CITY OF UNI- <br /> VERSITY CITY, THE LAND CLEARANCE FOR REDEVELOPMENT <br /> AUTHORITY OF UNIVERSITY CITY, MISSOURI, AND THE <br /> UNIVERSITY CITY- REDEVELOPMENT CORPORATION; AUTHORIZING <br /> THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS <br /> NECESSARY TO IMPLEMENT THIS ORDINANCE; CONTAINING A <br /> SEVERABILITY CLAUSE AND AN EMERGENCY CLAUSE. <br /> WHEREAS, by Ordinance No. 5450, the City Council of the City of <br /> University City found the Parkview Gardens Rehabilitation Area, as more <br /> particularly described in the Modified Development Plan attached hereto as <br /> Exhibit A (and hereafter referred to as the "Project Area") had become an <br /> economic and social liability by reason of conditions which are conducive to <br /> ill health, transmission of disease, crime or inability to pay reasonable <br /> taxes and found the Project Area to be a blighted area as defined by Section <br /> 343.020(2) of the Revised Statutes of Missouri, 1978, as amended, and by <br /> Ordinance No. 5085 of the City of University City; and <br /> WHEREAS, by Ordinance No. 5450 the City of University City <br /> initially approved the Redevelopment Plan for the Parkview Gardens Rehabili- <br /> tation Area; and <br /> WHEREAS, by reason of age, obsolescence, inadequate or outmoded <br /> design or physical deterioration, the Project Area continues to be an <br /> economic and social liability by reason of conditions which are conducive of <br /> ill health, transmission of disease, crime or inability to pay reasonable <br /> taxes; and <br /> WHEREAS, the rehabilitation, replanning, clearance or recon- <br /> struction of such Project Area is necessary and in the public interest under <br /> Chapter 353 of the Revised Statutes of Missouri, 1978, as amended, and <br /> Ordinance 5085 of the City of University City, as amended, and is necessary <br /> fo the preservation of the health, safety, morals and general welfare of the <br /> people of the City of University City; and <br />
