BILL NO. <br /> <br />7805 <br /> <br />INTRODUCED BY COUNCILMEMBER ADAMS <br /> <br /> ORDINANCE NO. <br /> <br />5601 <br /> <br />AN ORDINANCE AMENDING CHAPTER 12A OF THE MUNICIPAL CODE OF <br />THE CITY OF UNIVERSITY CITY BY REPEALING ORDINANCE NO. <br />5597, ENACTED MARCH 30, 1987, AND ENACTING IN LIEU THEREOF <br />A NEW CHAPTER TO BE KNOWN AS "CHAPTER 12A. FLOODPLAIN <br />MANAGEMENT", IN ORDER TO COMPLY WITH CERTAIN REVISIONS NOW <br />REQUIRED BY REVISED FEDERAL RULES; PROVIDING A PENALTY. <br /> <br />NOW THEREFORE, BE IT ORDAINED . BY THE COUNCIL OF .THE CITY OF <br /> <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br />Section 1. Chapter 12A of the Municipal Code of the City of Univer- <br /> <br />sity City, Missouri, is hereby amended by repealing Ordinance No. 5597, <br /> <br />enacted March 30, 1987, and enacting in lieu thereof a new Chapter to be known <br /> <br />as "Chapter 12A. Floodplain Management", relating to the same subject which <br /> <br />shall read as follows: <br /> <br />Chapter 12A <br /> <br />Floodplatn Management <br /> <br />Sec. 12A-1. Definitions. <br />Unless specifically defined below, words or phrases used <br />in this ordinance shall be interpreted so as to give them <br />the meaning they have in common usage and to give this <br />chapter its most reasonable application. <br /> <br />"Appeal" means a request for a review of the local <br />administrator's interpretation of any provision of this <br />chapter or a request for a variance. <br /> <br />"Area of shallow flooding" means a designated AO Zone on a <br />community's Flood Insurance Rate ,Map (FIRM) with base <br />flood depths from one to three feet where a clearly <br />defined channel does not exist, where the path of flooding <br />is unpredictable and indeterminate, and where velocity <br />flow may be evident. <br /> <br />"Area of special flood hazard" is the land in <br />plain within a community subject to a one <br />greater chance of flooding in any given year. <br /> <br />the flood- <br />percent or <br /> <br />"Base flood" means the flood having a one percent chance <br />of being equaled or exceeded in any given year. <br /> <br />"Building" a structure designed for the housing, enclosure <br />or shelter of persons, animals or property of any kind. <br /> <br />"Development" means any man-made change to improved or <br />unimproved real estate, including but not limited' to <br />buildings or other structures, mining, dredging, filling, <br />grading, paving, excavation or drilling operations. <br /> <br />"Existing construction" means (for the purposes <br />mining rates) structures for which the <br />construction" commenced before June 1, 1978. <br />construction" may also be referred to as <br />structures." <br /> <br /> of deter- <br />"start of <br /> "Existing <br /> "existing <br /> <br />"Flood" or "flooding" means a general and temporary con- <br />dition of partial or complete inundation of normally dry <br />land areas from: <br /> (1) The overflow of inland or tidal waters; <br /> (2) The unusual and rapid accumulation of runoff or <br /> surface waters from any source. <br /> <br /> <br />
