Y <br /> INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> BILL NO. 7813 _ ORDINANCE NO. 5609 <br /> AN ORDINANCE AMENDING CHAPTER 23 OF THE MUNICIPAL CODE OF THE <br /> CITY OF UNIVERSITY CITY, RELATING TO OFFENSES--MISCELLANEOUS, <br /> BY REPEALING SECTION 23-42 THEREOF, AS ENACTED BY ORDINANCE <br /> NO. 5126, ENACTED DECEMBER 4, 1978, RELATING TO PICKETING <br /> BEFORE OR ABOUT THE RESIDENCE OR DWELLING OF ANY INDIVIDUAL, <br /> AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br /> "SECTION 23-42. PICKETING BEFORE OR ABOUT THE RESIDENCE OR <br /> DWELLING OF ANY INDIVIDUAL," SO AS TO LIMIT THE PROHIBITION <br /> AGAINST PICKETING TO RESIDENTIALLY ZONED DISTRICTS; CONTAIN- <br /> ING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br /> MISSOURI, AS FOLLOWS: <br /> Section 1. Chapter 23 of the Municipal Code of the City of <br /> University City, relating to Offenses--Miscellaneous is hereby amended by <br /> repealing Section 23-42 thereof, as enacted by Ordinance No. 5126, enacted <br /> December 4, 1978, relating to picketing before or about the residence or <br /> dwelling of any individual; and enacting in lieu thereof a new section to be <br /> known as "Section 23-42. Picketing before or about the residence or dwelling <br /> of any individual, " relating to the same subject, and re-enacting said section <br /> so that said section, as so amended, shall read as follows: <br /> It shall be unlawful for any person to engage in picketing <br /> before or about the residence or dwelling of any individual, <br /> where such residence or dwelling is located in any area <br /> designated residentally zoned in the Zoning Code of the City. <br /> Section 2. This ordinance shall not be construed so as to relieve <br /> any person, firm or corporation from any penalty heretofore incurred by the <br /> violation of Section 23-42 nor bar the prosecution for any such violation. <br /> Section 3. Any person, firm or corporation violating any of the <br /> provisions of this ordinance, shall, upon conviction thereof, be subject to <br /> the penalty provided in Chapter 1, Section 1-8 of the Municipal Code of the <br /> City of University City. <br /> Section 4.
