ARTICLE 4 <br /> <br />LIGHT, VENTILATION AND SPACE <br />REQUIREMENTS <br /> <br />SECTION 17-400.0 GENERAL <br /> <br />17-400.1 Scope: The provisions of this article shall govern the minimum <br />conditions and standards for the light, ventilation and space for the occu- <br />pancy of a structure. All light, ventilation and space conditions shall <br />comply with the requirements herein prescribed insofar as they are applicable. <br /> <br />17-400.2 Responsibility: The owner of the structure shall provide and main- <br />tain such light, ventilation and space conditions in compliance with these <br />requirements. A person shall not occupy or use, or let to another for <br />occupancy or use, or permit any person to occupy or use any premises which <br />does not comply with the requirements of this article. <br /> <br />17-400.3 Access to public property: All structures shall provide access to <br />public property. Such access shall be maintained unobstructed. <br /> <br />17-400.4 Open space: An open space when used for the origin of light and <br />ventilation shall remain unobstructed. <br /> <br />17-400.5 Alternative devices: In place of the means for natural light and <br />ventilation herein prescribed, alternative arrangements of windows, louvers, <br />or other methods and devices that will provide the equivalent minimum perform- <br />ance requirements shall be permitted when complying with the building code. <br /> <br />SECTION 17-401.0 LIGHT <br /> <br />17-401.1 General: All spaces or rooms shall be provided sufficient light so <br />as not to endanger health or safety. <br /> <br />17-401.2 Habitable spaces: Every habitable space shall have at least one <br />window of approved size facing directly to the outdoors or to a court. The <br />minimum total window area, measured between stops, for every habitable room <br />shall be 8 percent of the floor area of such room, except in kitchens when <br />artificial light is provided in accordance with the provisions of the building <br />code. Whenever walls or other portions of a structure face a window of any <br />room and such obstructions are located less than 3 feet (914 mm) from the <br />window and extend to a level above that of the ceiling of the room, such a <br />window shall not be deemed to face directly to the outdoors nor to a court and <br />shall not be included as contributing to the required minimum total window <br />area for the room. <br /> <br />17-401.3 Common halls and stairways: Every common hall and stairway in every <br />building, other than one and two family dwellings shall be adequately lighted <br />at all times with an illumination of at least a 60 watt standard incandescent <br />light bulb (800 lumens) or equivalent for each 200 square feet (18.60 m2) of <br />floor area, provided that the spacing between light fixtures shall not be <br />greater than 30 feet (9144 mm). Every exterior stairway other than for one <br />and two family dwellings shall be illuminated at all times with a minimum of <br />one foot candle (10.76 lux) at floors, landings and treads. <br /> <br />17-401.4 Other spaces: All other spaces shall be provided with natural or <br />artificial light of sufficient intensity and so distributed as to permit the <br />maintenance of sanitary conditions, and the safe use of the space and the <br />appliances, equipment and fixtures. <br /> <br />SECTION 17-402.0 VENTILATION <br /> <br />17-402.1 General: All spaces or rooms shall be provided sufficient natural <br />or mechanical ventilation so as not to endanger health or safety. Where <br />mechanical ventilation is provided in lieu of the natural ventilation, such <br />mechanical ventilating system shall be maintained in operation during the <br />occupancy of any structure or portion thereof. <br /> <br />19 <br /> <br /> <br />
