i) Failure to Comply_. It shall be unlawful for the owner, <br /> keeper or harborer of a pit bull dog within the City of <br /> University City to fail to comply with the limitations, <br /> requirements and conditions set forth in this ordinance. <br /> Any do~ found to be the subject of a violation of this <br /> ordinance shalt be subject to revocation of the license <br /> and/or registration of the animal and irmaediate seizure <br /> and impoundment. The owner shall be required to take <br /> necessary actio~ to dispose of such pit bull and the <br /> Director of Public Works is further authorized to dispose <br /> of such pit bull if necessary action is not taken by the <br /> owne F, <br /> <br />j) Violations and Penaltie__~s. Any person violating or permit- <br /> ting the violation of any provision of this ordinance <br /> shall upon conviction in Municipal Court be fined a sum <br /> not less than $200.00 and not more than $500.00. In <br /> addition to the fine imposed the Court may sentence the <br /> defendant to imprisonment in the county jail for a period <br /> not to exceed thirty (30) days. In addition, the court <br /> shall order the registration of the subject pit bull dog <br /> revoked and the dog removed from the City. Should the <br /> defendant refuse to remove the dog from the City the <br /> municipal court judge shall find the defendant owner in <br /> contempt and order the immediate confiscation and impound- <br /> ment of the animal. Each day that a violation of this <br /> ordinance coutinues shall be deemed a separate offense. <br /> In addition to the foregoing penalties, any person ~ho <br /> violates this ordinance shall pay all expenses, including <br /> shelter, food, handling, veterinary care and testimony <br /> necessitated by the enforcement of ~his ordinance. <br /> <br />Section 2. Severability. If any section, sentence, clause or phrase of <br /> <br />this ordinance is for any reason held to be invalid or unconstitutional by a <br /> <br />decision of any court of competent jurisdiction, such decision shall not affect the <br /> <br />validity of 'the remaining portions of this ordinance. <br /> <br /> Section 3. Enforcement. The Director of Public Works of University City, <br /> <br />Missouri, is vested with full power a~d authority to enforce the provisions of this <br /> <br />ordinance. <br /> <br />Section 4. This ordinance shall not be construed so as to relieve any <br /> <br />person, firm or corporation from any penalty heretofore incurred by the violation of <br /> <br />Chapter 5 of the U~iversity City Municipal Code, nor bar the prosecution for any <br /> <br />such violation. <br /> <br />Section 5.
