i) Failure to Comply_. It shall be unlawful for the owner, keeper or harborer of a pit bull dog within the City of University City to fail to comply with the limitations, requirements and conditions set forth in this ordinance. Any do~ found to be the subject of a violation of this ordinance shalt be subject to revocation of the license and/or registration of the animal and irmaediate seizure and impoundment. The owner shall be required to take necessary actio~ to dispose of such pit bull and the Director of Public Works is further authorized to dispose of such pit bull if necessary action is not taken by the owne F, j) Violations and Penaltie__~s. Any person violating or permit- ting the violation of any provision of this ordinance shall upon conviction in Municipal Court be fined a sum not less than $200.00 and not more than $500.00. In addition to the fine imposed the Court may sentence the defendant to imprisonment in the county jail for a period not to exceed thirty (30) days. In addition, the court shall order the registration of the subject pit bull dog revoked and the dog removed from the City. Should the defendant refuse to remove the dog from the City the municipal court judge shall find the defendant owner in contempt and order the immediate confiscation and impound- ment of the animal. Each day that a violation of this ordinance coutinues shall be deemed a separate offense. In addition to the foregoing penalties, any person ~ho violates this ordinance shall pay all expenses, including shelter, food, handling, veterinary care and testimony necessitated by the enforcement of ~his ordinance. Section 2. Severability. If any section, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of 'the remaining portions of this ordinance. Section 3. Enforcement. The Director of Public Works of University City, Missouri, is vested with full power a~d authority to enforce the provisions of this ordinance. Section 4. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty heretofore incurred by the violation of Chapter 5 of the U~iversity City Municipal Code, nor bar the prosecution for any such violation. Section 5. This Ordinance is hereby declared to be necessary for the immediate preservation of the public health and safety of the citizens of this City and as such is an emergency ordinance which shall take immediate effect upon its passage.
