BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER WAGNER <br />7850 ORDINANCE NO. 5646 <br /> <br />AN ORDINANCE A~NDING CHAPTER 4 OF THE MUNICIPAL CODE OF THE CITY <br />OF UNIVERSITY CITY, RELATING TO ALCOHOLIC BEVERAGES, BY REPEALING <br />SECTION 4-45 THEREOF, AS AMENDED BY ORDINANCE NO. 5164, ENACTED <br />APRIL 29, 1979, RELATING TO HOURS OF SALE OF ALCOHOLIC BEVERAGES, <br />AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS <br />"SECTION 4-45. HOURS OF SALE; SALE ON SUNDAY; HOURS OF CLOSING," <br />BY AMENDING SAID SECTION SO AS TO DELETE THE CLOSING REQUIREMENT <br />ON ANY ELECTION DAY; CONTAINING A SAVING CLAUSE AND PROVIDING A <br />PENALTY. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS <br /> <br />FOLLOWS: <br /> <br />Section 1. Chapter 4 of the Municipal Code of the City of University <br /> <br />City, relating to alcoholic beverages, is hereby amended by repealing Section 4-45 <br /> <br />thereof, as amended by Ordinance No. 5164, enacted April 29, 1979, relating to <br /> <br />hours of sale of alcoholic beverages, and enacting in lieu thereof a new section <br /> <br />to be known as "Section 4-45. Hours of sale; sale on Sunday; hours of closing," <br /> <br />by amending said section so as to delete the closing requirement on any election <br /> <br />day, relating to the same subject, and re-enacting said section so that said <br /> <br />section, as so amended, shall read as follows: <br /> <br />Section 4-45. Hours of sale; sale on Sunday; hours of closing. <br />It shall be unlawful for any licenses or anyagent or employee of <br />such licensee under this article to sell, give away or otherwise <br />dispose of or suffer the same to be done upon or about his <br />premises any non-intoxicating beer in any quantity between the <br />hours of 1:30 A.M. and 6:00 A.M., nor shall any such person sell, <br />give away or otherwise dispose of or suffer the same to be done <br />upon or about such premises any non-intoxicating beer in any <br />quantity whatever between the hours of 1:30 A.M. and i:00'P.M. on <br />the first day of the week commonly called Sunday- <br /> <br />It shall be unlawful for any person having a license under this <br />article to remain open for business to the public between the <br />hours of 1:30 A.M. and 6:00 A.M. on weekdays or on Saturday, or <br />after 1:30 A.M. on Sunday. <br /> <br />Section 2. This ordinance shall not be construed so as to relieve any <br /> <br />person, firm or corporation from any penalty heretofore incurred by the violation <br />of Section 4-45, nor bar the prosecution for any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating any of the provi- <br />sions of this ordinance, shall, upon conviction thereof, be subject to the penalty <br /> <br />provided in Chapter 1, Section 1-8 of the Municipal Code of the City of University <br /> <br />City. <br /> <br />Section 4. <br /> <br />This ordinance shall take effect and be in force from and <br /> <br />after its passage, as provided by law. <br /> <br /> PASSED this 7th day of March <br /> <br />ATTEST: <br /> <br /> CITY CL~RK <br /> <br />CERTIFIED TO BE CORRECT AS TO FO~4: <br /> <br />1988.~_~ ~ <br /> ~MAYOR ~ <br /> <br /> <br />
