accordance with this Ordinance and Ordinance No. 5687 are <br />hereby ratified. Pursuant to Section 99.845 of the Act and <br />Ordinance No. 5687, payments in lieu of taxes have been and <br />shall be collected by the St. Louis County Collector of <br />Revenue and paid to the Finance Director with respect to real <br />property in the Area. The Finance Director has been and <br />shall deposit such payments in the Special Allocation Fund'to <br />be used for the purposes set forth in this ordinance. The <br />Finance Director and all other appropriate City officials are <br />further authorized and directed to enter into such agreements <br />(i) for collection of moneys to be deposited in the Special <br />Allocation Fund and (ii) for disbursements from the Special <br />Allocation Fund for purposes of paying redevelopment project <br />costs as they ehali deem necessary, desirable, convenient or <br />proper. <br /> <br /> Section 5. The City Council hereby finds and determines <br />that it is necessary for the implementation of the Plan for <br />the Area to authorize and direct the Finance Director of the <br />City to create a subaccount of the Special Allocation Fund <br />which subaccount shall be known as the "Westover Subaccount <br />of the Special Allocation Fund" and which shall be a part of <br />the Fund held separate and apart from the City's other funds <br />and from the remainder of the Fund and administered by the <br />Finance Director in accordance with this Ordinance. Payments <br />in lieu of taxes collected by the St. Louis County Collector <br />of Revenue and paid to the Finance Director pursuant to <br />Section 99.845 of the Act and Ordinance No. 5687 with respect <br />to real property in the Area which is legally described as <br />Exhibit ~ hereto (the "Westover Area") shall be segregated by <br />the St. Louis County Collector of Revenue from the total <br />amount of payments in 'lieu of taxes collected for other real <br />property in the Area. If the St. Louis County Collector of <br />Revenues does not so segregate the payments in lieu of taxes <br />from the Westover Area, the Finance Director shall estimate <br />the amount thereof based upon copies of real property tax <br />bills given to the Commission and the City by the Developer. <br />The Finance Director s~all deposit such segregated payments <br />in the Nestover Subaccount of the Special Allocation Fund <br />from which disbursements shall be made to finance the <br />redevelopment project costs in the amount of $/~/j~(9 <br />incurred in connection with the Plan as s t f rth in an <br /> e o <br />Agreement, a Note and a Pledge Agreement with Developer in <br />substantially the form of attached hereto as Exhibits C, D <br />and E, respectively (the "Agreement," the "Note," and "Pledge <br />Agreement" respectively). The City's obligations under the <br />Agreement, the Note and the Pledge Agreement shall not be <br />general obligations of the City, but shall be payable solely <br />from the Westover Subaccount of the Special Allocation Fund. <br />The Finance Director and the City Manager are further <br />authorized and directed to enter into agreements (i) for <br />collection of moneys to be deposited in the Westover <br />Subaccount of the Special Allocation Fund and (ii) for <br />disbursements from the Westover Subaccount of the Special <br /> <br />-2- <br /> <br /> <br />
