BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> <br />8098 ORDINANCE NO. <br /> <br />5886 <br /> <br />AN ORDINANCE AMENDING CHAPTER 1 OF THE MUNICIPAL <br />CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO <br />GENERAL PROVISIONS BY REPEALING SECTION 1-8 <br />THEREOF, AS ENACTED BY ORDINANCE NO. 3970, ENACTED <br />JULY 15, 1963, RELATING TO GENERAL PENALTY; <br />CONTINUING VIOLATIONS," AND ENACTING IN LIEU <br />THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 1-8, <br />GENERAL PENALTY; CONTINUING VIOLATIONS," SO AS TO <br />ALLOW FOR A SUSPENDED SENTENCE OR PROBATION; <br />CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section ~. Chapter i of the Municipal Code of the City <br />of University City, relating to General Provisions is hereby <br />amended by repealing Section 1-8 thereof, as enacted by <br />Ordinance No. 5970, enacted July 15, 1963, relating to <br />general penalty, continuing violations and enacting in lieu <br />thereof a new section to be known as "Section 1-8, General <br />Penalty; Continuing Violations," so as to allow for a <br />suspended sentence or probation; relating to the same <br />subject, and re-enacting said section so that said section, <br />as so amended, shall read as follows: <br /> <br />SEC 1-8. GENERAL PENALTY; CONTINUING VIOLATIONS <br /> <br />Whenever in any section of this Code or in any <br />ordinance the doing of an act is required or is <br />prohibited or is declared to be unlawful or a <br />misdemeanor, and no specific fine or penalty is <br />provided for a violation thereof, any person who <br />shall be found guilty of a violation of any <br />provision of this Code or any such ordinance, <br />shall, for each offense, be fined not more than <br />five hundred dollars or be punished by imprisonment <br />in the city jail not exceed ninety days, or be <br />punished by both fine and imprisonment. <br /> <br />Each day's violation of, or failure, refusal or <br />neglect to comply with any provision of this Code <br />or of any ordinance shall constitute a separate and <br />distinct offense. <br /> <br />Notwithstanding the preceding paragraphs of this <br />section, the Court may suspend imposition or <br />execution of sentence and place a person on <br />probation for a specific period not to exceed two <br />years upon a finding of guilty of violating any <br />ordinance or provision of this Code, unless the <br />ordinance or provision violated expressly states <br />that probation shall be granted for a violation <br /> <br /> <br />
