BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER PRICE <br /> <br />8099 ORDINANCE NO. <br /> <br />5887 <br /> <br />CITY, <br /> <br />AN ORDINANCE AMENDING CHAPTER 21 OF THE MUNICIPAL <br />CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO <br />MOTOR VEHICLES AND TRAFFIC BY REPEALING SECTION <br />21-107 THEREOF, AS ENACTED BY ORDINANCE NO. 3970, <br />ENACTED JULY 15, 1965, RELATING TO DRIVING WHILE <br />INTOXICATED AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS "SECTION 21-107.1, DRIVING <br />WHILE INTOXICATED," SO AS TO COMPLY WITH THE <br />STATUTES OF THE STATE OF MISSOURI; CONTAINING A <br />SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />MISSOURI, AS FOLLOWS: <br /> <br /> Section ~. Chapter 21 of the Municipal COde of the City <br />of University City, relating to Motor Vehicles and Traffic is <br />hereby amended by repealing Section 21-107 thereof, as <br />enacted by Ordinance No. 5970, enacted July 15, 1963, <br />relating to driving while intoxicated and enacting in lieu <br />thereof a new section to be known as "Section 21-107.1, <br />Driving While Intoxicated," so as to comply with the statutes <br />of the State of Missouri; relating to the same subject, and <br />re-enacting said section so that said section, as so amended, <br />shall read as follows: <br /> <br />SEC 21-107.1 DRIVING WHILE INTOXICATED <br /> <br />1. No person shall operate a motor vehicle while <br />in an intoxicated or drugged condition. <br /> <br />2. As used in this section, a person is in an <br />"intoxicated condition" when he is under the <br />influence of alcohol, a controlled substance, or <br />drug, or any combination thereof. <br /> <br /> 3. As used in this section, the term "driving" or <br /> "operate" means physically driving or operating or <br />'~n~ f~ ~uLu~ pI,y~iCdl '-~ontrO! O~ --a m~tor <br />vehicle. <br /> <br /> Section 2. This ordinance shall not be construed so as <br />to relieve any person, firm or corporation from any penalty <br />heretofore incurred by the violation of Section 21-107 nor <br />bar the prosecution for any such violation. <br /> <br /> Section 3. Any person, firm or corporation violating <br />any of the provisions of this ordinance shall, upon <br />conviction thereof, be subject to the penalty provided in <br />Chapter 1, Section 1-8, of the Municipal Code of the City of <br />University City. <br /> <br />-1- <br /> <br /> <br />
