BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER ADAMS <br /> <br />8100 ORDINANCE NO. <br /> <br />5888 <br /> <br />AN ORDINANCE AMENDING CHAPTER 21 OF THE MUNICIPAL <br />CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO <br />MOTOR VEHICLE AND TRAFFIC AND ENACTING THEREIN A <br />NEW SECTION TO BE KNOWN AS "SECTION 21-107.2, <br />DRIVING WITH EXCESSIVE BLOOD ALCOHOL CONTENT," SO <br />AS TO COMPLY WITH THE STATUTES OF THE STATE OF <br />MISSOURI; AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 21 of the Municipal Code of the City <br />of University City, relating to Motor Vehicles and Traffic is <br />hereby amended by enacting therein a new section to be known <br />as "Section 21-107.2, Driving with Excessive Blood Alcohol <br />Content," so as to comply with the Statutes of the State of <br />Missouri, reading as follows: <br /> <br />SEE 21-107.2. DRIVING WITH EXCESSIVE BLOOD ALCOHOL <br /> CONTENT <br /> <br />1. No person shall operate a motor vehicle with <br />ten-hundredths of one percent or more by weight of <br />alcohol in his blood. <br /> <br />2. As used in this section, percent by weight of <br />alcohol in the blood shall be based upon grams of <br />alcohol per one hundred milliliters of blood and <br />may be shown by chemical analysis of the personIs <br />blood, breath, saliva or urine. For purposes of <br />determining the alcoholic content of a personIs <br />blood under this section, the test shall be <br />conducted in accordance with the provisions of <br />577.020 to 755.041RSMo. <br /> <br />3. As used in this section, the term "driving" or <br />"operate" means physically driving or operating or <br />being in actual physical control of a motor <br />vehicle. <br /> <br /> Section 2. Any person, firm or corporation violating <br />any of the provisions of this ordinance, shall, upon <br />conviction thereof, be subject to the penalty provided in <br />Chapter 1, Section 1-8, of the Municipal Code of the City of <br />University City. <br /> <br />-1- <br /> <br /> <br />
