BILL <br /> <br /> INTRODUCEDBY COUNCILMEMBER SCHUMAN <br /> <br />NO. 8102 ORDINANCE NO. 5890 <br /> <br />AN ORDINANCE AMENDING CHAPTER 21 OF THE MUNICIPAL <br />CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO <br />MOTOR VEHICLE AND TRAFFIC AND ENACTING THEREIN A <br />NEW SECTION TO BE KNOWN AS "SECTION 21-I07.4, <br />REIMBURSEMENT OF COSTS OF ARREST," SO AS TO COMPLY <br />WITH THE STATUTES OF THE STATE OF MISSOURI; AND <br />PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 21 of the Municipal Code of the City <br />of University City, relating to Motor Vehicles and Traffic is <br />hereby amended by enacting therein a new section to be known <br />as "Section 21-107.4, Reimbursement of costs. of Arrest," so <br />as to comply with the Statutes of the State of Missouri, <br />reading as follows: <br /> <br />SEC 21-107.4. REIMBURSEMENT OF COSTS OF ARREST <br /> <br />Upon a plea of guilty or a finding of guilty of <br />violating Section 21-107.1 or 21-107.2, the Court <br />may, in addition to imposition of any penalties <br />provided by law, order the convicted person to <br />reimburse the state or local law enforcement agency <br />which made the arrest for the costs associated with <br />such arrest. Such costs shall include the reason- <br />able cost of making the arrest, including the cost <br />of any chemical test made under this chapter to <br />determine the alcohol or drug content of the <br />person's blood, and the costs of processing, <br />charging, booking and holding such person in <br />custody. The state and each local law enforcement <br />agency may establish a schedule of such costs; <br />however, the Court may order the costs reduced if <br />it determines that the costs are excessive. <br /> <br /> Section 2. Any person, firm or corporation violating <br />any of the provisions of this ordinance, shall, upon <br />conviction thereof, be subject to the penalty provided in <br />Chapter 1, Section 1-8, of the Municipal Code of the City of <br />University City. <br /> <br />-1- <br /> <br /> <br />
