BILL INTRODUCEDBY COUNCILMEMBER SCHUMAN NO. 8102 ORDINANCE NO. 5890 AN ORDINANCE AMENDING CHAPTER 21 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO MOTOR VEHICLE AND TRAFFIC AND ENACTING THEREIN A NEW SECTION TO BE KNOWN AS "SECTION 21-I07.4, REIMBURSEMENT OF COSTS OF ARREST," SO AS TO COMPLY WITH THE STATUTES OF THE STATE OF MISSOURI; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 21 of the Municipal Code of the City of University City, relating to Motor Vehicles and Traffic is hereby amended by enacting therein a new section to be known as "Section 21-107.4, Reimbursement of costs. of Arrest," so as to comply with the Statutes of the State of Missouri, reading as follows: SEC 21-107.4. REIMBURSEMENT OF COSTS OF ARREST Upon a plea of guilty or a finding of guilty of violating Section 21-107.1 or 21-107.2, the Court may, in addition to imposition of any penalties provided by law, order the convicted person to reimburse the state or local law enforcement agency which made the arrest for the costs associated with such arrest. Such costs shall include the reason- able cost of making the arrest, including the cost of any chemical test made under this chapter to determine the alcohol or drug content of the person's blood, and the costs of processing, charging, booking and holding such person in custody. The state and each local law enforcement agency may establish a schedule of such costs; however, the Court may order the costs reduced if it determines that the costs are excessive. Section 2. Any person, firm or corporation violating any of the provisions of this ordinance, shall, upon conviction thereof, be subject to the penalty provided in Chapter 1, Section 1-8, of the Municipal Code of the City of University City. -1-
