INTRODUCED BY COUNCILM~MBER SCH00MER 8123 ORDINANCE NO. 5911 AN ORDINANCE PROVIDING FOR THE EXECUTION OF A POLE LICENSE AGREEMENT WITH UNION ELECTRIC COMPANY, A MISSOURI CORPORATION, AND THE CITY OF UNIVERSITY CITY, PROVIDING FOR THE ATTACHMENT OF CERTAIN TERMS TO CERTAIN POLES OF SAID UNION ELECTRIC COMPANY; AND CONTAINING AN EMERGENCY CLAUSE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. That the attached Pole License Agreement, in the form as set out, by and between the City of University City, State of Missouri, and Union Electric Company, a corporation, its successors and assigns, providing for the '~tac~ment o7 c"~FE'a~'~terms ~o 'c~ih"~Ie~o'6=F'~f~ ~idn Electric Company, according to the terms, provisions, stipulations, and agreements therein specified, be and the same is hereby approved and confirmed, and that the City Manager is authorized and directed to execute in behalf of the said City of University City,the Pole License Agreement, which is attached hereto and is incorporated as a part of this ordinance as if fully set out herein. Section 2. If any provision of this ordinance, or the application of such provision to particular circumstances, shall be held invalid, the remainder of this ordinance, or the application of such provision to circumstances other than those as to which it is held invalid, shall not be affected thereby. Section 5. An emergency is hereby declared to exist in that it is necessary that this ordinance pass by the May 51 holiday.
