BILL NO. <br /> <br /> INTRODUC~ BY COUNCILMEMBERTHOMPSON <br /> <br />8127 ORDINRNCE NO. <br /> <br />5915 <br /> <br />AN ORDINANCE AMENDING CHAPTER 1 OF THE MUNICIPAL <br />CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO <br />GENERAL PROVISIONS, AND ENACTING THEREIN A NEW <br />SECTION TO BE KNOWN AS "SECTION 1-8.3. ATTEMPT;" <br />AND PROVIDING A PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter I of the Municipal Code of the City <br />of University City, relating to General Provisions is hereby <br />amended enacting therein a new section to be known as <br />"Section 1-8.3. Attempt;" reading as follows: <br /> <br />1-8.5. ATTEMPT. <br /> <br />1. A person is guilty of attempt to commit an ordinance <br />violation when, with the purpose of committing the <br />ordinance violation, he does any act which is a <br />substantial step towards the commission of the ordinance <br />violation. A "substantial step" is conduct which is <br />strongly corroborative of the firmness of the actor's <br />purpose to complete the commission of the ordinance <br />violation. <br /> <br />2. It is no defense to a prosecution under this section <br />that the ordinance violation attempted was, under the <br />actual attendant circumstances, factually or legally <br />impossible of commission, if such ordinance violation <br />could have been committed had the attendant <br />circumstances been as the actor believed them to be. <br /> <br />Section 2. Any person, firm or corporation violating any of <br />the provisions of this ordinance shall, upon conviction <br />thereof, be subject to the penalty provided in Chapter 1, <br />Section I-8 of the Municipal Code of the City of University <br />City. <br /> <br /> <br />
