INTRODUCED BY COUNCILM~MBER SCHOOMER 8132 ORDINANCE NO. 5920 AN ORDINANCE AMENDING CHAPTER 4 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO ALCOHOLIC BEVERAGES BY REPEALING SECTION 4-5i THEREOF, AS ENACTED BY ORDINANCE NO. 4677, ENACTED SEPTEMBER 27, 197i, RELATING TO SUNDAY SALES AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 4-5i. SUNDAY SALES," SO AS TO CONFORM WITH THE STATE OF MISSOURI LIQUOR LAWS; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section i. Chapter 4 of the Municipal Code of the City of University City, relating to alcoholic beverages is hereby amended by repealing Section 4-51 thereof, as enacted by Ordinance No. 4677, enacted September 27, 1971, relating to Sunday sales and enacting in lieu thereof a new section to be known as "Section 4-51. Sunday Sales," relating to the same subject, and re-enacting said section so that said section, as so amended, shall read as follows: SECTION 4-51 SUNDAY SALES Anyone licensed by the State of Missouri to sell intoxicating liquor between the hours of 1:00 p.m. and midnight on Sundays may apply for, and the finance department may issue, a license authorizing such sales in the City of University City upon payment, in addition to all other fees required by law or ordinance, of an additional fee of $500.00 per calendar year, payable at the same time and in the same manner as applicant's other liquor license fees to this city. Section 2. This ordinance shall not be construed so as to relieve any person, firm or corporation from any penalty heretofore incurred by the violation of Section 4-51 nor bar the prosecution for any such violation. Section 3. Any person, firm or corporation violating any of the provisions of this ordinance shall, upon conviction thereof, be subject to the penalty provided in Chapter 1, Section 1-8 of the Municipal Code of the City of University City.
