BILL NO. 8148 <br /> <br />INTRODUCED BY COUNCILMEMBER SCHUMAN <br /> <br /> ORDINANCE NO. <br /> <br />5935 <br /> <br />AN ORDINANCE AMENDING CHAPTER 54 OF THE MUNICIPAL CODE <br />OF THE CITY OF UNIVERSITY CITY RELATING TO ZONING BY <br />REPEALING SECTION 54-55.4 AS AMENDED BY ORDINANCE NO. <br />5829, ENACTED OCTOBER 7, i99i, RELATING TO "GC" GENERAL <br />COMMERCIAL DISTRICT, AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS "SECTION 54-55.4. CONDITIONAL <br />USES," BY ADDING THE CLASSIFICATION OF "ACCESS ROAD"; <br />CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of <br />University City (University City Zoning Code) divides the City into <br />several zoning districts, and regulates the uses to which the premises <br />located therein may be put; and <br /> <br /> WHEREAS, Section 34-55.4 provides for "conditional uses" under the <br />same type of district; and <br /> <br /> WHEREAS, the City Plan Commission, in a meeting held at the City <br />Hall on August 25, 1993, at 7:30 p.m. recommended an amendmentof <br />Section 54-55 of the University City Zoning Code by adding "access <br />road" to Section 54-55.4; and <br /> <br /> WHEREAS, a due notice of a public hearing to be held by the City <br />Council in the City Council Chambers at City Hall at 7:30 p.m. on <br />October 4, 1995, was duly published in the Watchman-Advocate, a <br />newspaper of general circulation within said City, on September 17, <br />1993; and <br /> <br /> WHEREAS, said public hearing was duly held at the time and place <br />specified in said notice, and all suggestions or objections concerning <br />such change in said section were duly heard and considered by the <br />Council. <br /> <br /> NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 54 of the Municipal Code of the City of <br />University City, Missouri, relating to zoning is hereby amended by <br />repealing Section 54-35.4 thereof, relating to "Conditional Uses" and <br />enacting in lieu thereof a new section to be known as "Section 54-55.4, <br />Conditional Uses," by adding "access road" relating to the same <br />subject, and re-enacting said section so that said section as so <br />amended, shall read as follows: <br /> <br />34-35.4 Conditional Uses. <br /> <br />The council, by conditional use permit, as provided in <br />section 54-65, after public hearing before the plan <br />commission and subject to such protective restrictions <br />and conditions that the council may deem necessary, may <br />authorize any of the following uses: <br /> <br />-1- <br /> <br /> <br />
