BILL NO. INTRODUCED BY COUNCILMEMBER PRICE 8150 ORDINANCE NO. 5937 AN ORDINANCE AMENDING CHAPTER 18 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, RELATING TO LICENSES AND BUSINESS REGULATIONS, BY REPEALING SECTION 18-57 THEREOF, AS AMENDED BY ORDINANCE NO. 5260, ENACTED NOVEMBER 5, 1980, RELATING TO LICENSE FEES AND THE PROCEDURE FOR LICENSING MERCHANTS BEGINNING BUSINESS DURING THE YEAR, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 18-57. LICENSE--LICENSE FEE AND PROCEDURE FOR LICENSING MERCHANTS BEGINNING BUSINESS DURING THE YEAR," BY AMENDING SAID SECTION BY EXEMPTING EXIST- ING BUSINESSES; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1: Chapter 18 of the Municipal Code of the City of University City, relating to Licenses and Business Regulations, is hereby amended by repealing Section 18-57 thereof, as amended by Ordinance No. 5260, enacted November 3, 1980, relating to license fees and the procedure'for licensing merchants beginning business during the year, and enacting in lieu thereof a new section to be known as "Section 18-57. Licnese--License Fee and Procedure for Licensing Merchants Beginning Business During the Year," by amending said section by exempting existing businesses relating to the same subject, and re-enacting said section so that said section, as so amended, shall read as follows: SECTION 18-57. LICENSE--LICENSE FEE AND PROCEDURE FOR LICENSING MERCHANTS BEGINNING BUSINESS DURING THE YEAR When any person first engages in business in the City as a merchant, except an ongoing existing business, it shall be his duty to make application to the Director of Finance for a license, as pre- scribed by this Article, and to pay a minimum license fee of Thirty Dollars ($50.00). Thereafter, on or before the last day of April of each calendar year, such person shall file with the Director of Finance a statement of the actual gross receipts during the preceding calendar year and pay the license tax computed upon such receipts according to the schedule set forth in Section 18-56. Section 2. This ordinance shall not be construed so as to relieve any person, firm, or corporation from any penalty heretofore incurred by the violation of Section 18-57 nor bar the prosecution for any such violation.
