increased in order to effect salvage of materials. <br /> <br />e) Upon presentation of satisfactory proof that the insured has removed or will remove <br />debris and repair, rebuild or otherwise make the insured premises safe and secure, the <br />code official shall issue a certificate within thirty (30) days after receipt of such <br />satisfactory proof to permit covered claim payment to the insured without deduction <br />payable to the City's Director of Finance as herein provided in this section. It shall be <br />the obligation of the insured or other person making claim to provide the insurance <br />company with such certificate. <br /> <br />0 No provision of this section shall be construed to make the City a party to any <br />insurance contract. <br /> <br />(SECTION 120.0 EMERGENCY MEASURES) <br /> <br />120.2 Temporary safeguards: Notwithstanding other provisions of this code, whenever <br />in the opinion of the code official, there is actual and immediate danger of collapse or <br />failure of a structure or any part thereof which would endanger life, or there is an actual <br />and immediate danger because a vacant or partially vacant building is unguarded or has <br />any open doors or windows, thereby creating a fire hazard or other security hazard or <br />endangering life or property, the code official shall require the occupants to vacate the <br />same forthwith and shall cause the necessary work to be done including the boarding-up <br />of all accessible openings, to render such building or structure or part thereof temporarily <br />safe. <br /> <br />(SECTION 121.0 MEANS OF APPEAL) <br /> <br />121.1 Application for appeal: Any interested person shall have the right to appeal a <br />decision of the code official to the Board of Appeals. An application for appeal shall be <br />based on a claim that the true intent of this code or the rules legally adopted thereunder <br />have been incorrectly interpreted, the provisions of this code do not fully apply, or an <br />equivalent form of construction can be used. <br /> <br />121.1.1 Filing procedure: All appeals shall be filed in writing with the code <br />official within thirty (30) days after the decision to be appealed is rendered by the <br />code official. Appeals must be accompanied by a fee in the amount specified in <br />local ordinances. <br /> <br />121.2 Membership of board: The Board of Appeals shall consist of seven members <br />appointed by the City Council. Board members shall be appointed for five year terms <br />and serve until a successor has been appointed. <br /> <br />121.2.1 Qualifications of board members: At least three of the members shall <br />have at least ten (10) years experience as a registered architect, builder, <br />superintendent of building construction or registered professional engineer with <br />structural, civil or architectural engineering experience. <br />121.2.2 Alternate members: Is hereby deleted in its entirety. <br /> <br />-7- <br /> <br /> <br />
