Bill No. <br /> <br /> INTRODUCED BY COUNCILM~BER ADAMS <br /> <br />8201 Ordinance No. 5986 <br /> <br />AN ORDINANCE APPROVING AND RATIFYING AN INTERGOVERNMENTAL <br />COOPERATION AGREEMENT BY AND BETWEEN TEE CITY OF UNIVERSITy <br />CITY AND THE LAND CLEARANCE FOR REDEVELOPMENT AUTHORITY <br /> OF THE CITY OF UNIVERSITy CITY; AUTHORIZING THE EXECUTION <br /> OF SAME ON BEHALF OF THE CITY; AUTHORIZING A LOAN <br /> TO THE AUTHORITy; AND AUTHORIZING ALL ACTS NECESSARY <br /> TO EFFECTUATE SAME. <br /> <br /> WHEREAS, the City of University City, Missouri (the "City") <br />wishes to contract with the Land Clearance for Redevelopment <br />Authority of the City of University City (the "Authority.) for <br />the planning and development of certain public improvements and <br />for the provision of certain common services and to define and <br />clarify their respective expectations and responsibilities with <br />regard to those improvements; and <br /> <br /> WHEREAS, the Cooperation Agreement attached hereto as <br />Exhibit A and incorporated herein by this reference, contains the <br />terms of the agreement between the City and the Authority with <br />respect to the aforesaid public improvements. <br /> <br />FINDINGS OF FACT <br /> <br /> A. The building located at 6346-70 Delmar Boulevard, <br />University City, Missouri (the "Tivoli Building") suffers from <br />extreme deferred maintenance and is in deteriorated and <br />insanitary condition. <br /> <br /> B. The elimination of the blighted conditions and <br />rehabilitation of the Tivoli Building, the restoration of the <br />historic features of the Tivoli Building, and the preservation of <br />the character of the surrounding neighborhood will serve a public <br />purpose of the City. <br /> <br /> C. The <br />Urban Renewal <br />redevelopment <br />99.300-715 of <br /> <br />Tivoli Building is located in the Eastgate-Westgate <br />Project Area MOR-43, a land clearance for <br />project area established pursuant to Sections <br />the Missouri Revised Statutes. <br /> <br /> D. The City and the Authority have determined that the <br />Authority is the appropriate body to oversee the rehabilitation <br />of the Tivoli Building and to ensure rehabilitation of the Tivoli <br />Building in compliance with the provisions of the Eastgate- <br />Westgate Urban Renewal Plan. <br /> <br /> E. The Cooperation Agreement between the City and the <br />Authority, attached hereto as Exhibit A, will advance the public <br />health, safety, morals and welfare of the residents of the City <br />and will serve a public purpose of the City. <br /> <br /> NOW THEREFORE, BE IT ORDAINED by the City Council of the <br />City of University City, Missouri as follows: <br /> <br /> t. The Cooperation Agreement is hereby approved and the <br />Mayor and the members of the City Council are hereby authorized <br />to execute same on behalf of the City and to take all actions <br />including, without limitation, a loan of funds and the execution <br />of all notes, Certificates, or other documents, necessary to <br />effectuate the terms of the Cooperation Agreement. <br /> <br /> 2. The portions of this Ordinance shall be severable. In <br />the event that any portion of this Ordinance is found by a court <br />of competent jurisdiction to be invalid, the remaining portions <br />of this Ordinance are valid, unless the court finds the valid <br />portions of this Ordinance are so essential and inseparably <br /> <br /> <br />
