Bill No. INTRODUCED BY COUNCILM~BER ADAMS 8201 Ordinance No. 5986 AN ORDINANCE APPROVING AND RATIFYING AN INTERGOVERNMENTAL COOPERATION AGREEMENT BY AND BETWEEN TEE CITY OF UNIVERSITy CITY AND THE LAND CLEARANCE FOR REDEVELOPMENT AUTHORITY OF THE CITY OF UNIVERSITy CITY; AUTHORIZING THE EXECUTION OF SAME ON BEHALF OF THE CITY; AUTHORIZING A LOAN TO THE AUTHORITy; AND AUTHORIZING ALL ACTS NECESSARY TO EFFECTUATE SAME. WHEREAS, the City of University City, Missouri (the "City") wishes to contract with the Land Clearance for Redevelopment Authority of the City of University City (the "Authority.) for the planning and development of certain public improvements and for the provision of certain common services and to define and clarify their respective expectations and responsibilities with regard to those improvements; and WHEREAS, the Cooperation Agreement attached hereto as Exhibit A and incorporated herein by this reference, contains the terms of the agreement between the City and the Authority with respect to the aforesaid public improvements. FINDINGS OF FACT A. The building located at 6346-70 Delmar Boulevard, University City, Missouri (the "Tivoli Building") suffers from extreme deferred maintenance and is in deteriorated and insanitary condition. B. The elimination of the blighted conditions and rehabilitation of the Tivoli Building, the restoration of the historic features of the Tivoli Building, and the preservation of the character of the surrounding neighborhood will serve a public purpose of the City. C. The Urban Renewal redevelopment 99.300-715 of Tivoli Building is located in the Eastgate-Westgate Project Area MOR-43, a land clearance for project area established pursuant to Sections the Missouri Revised Statutes. D. The City and the Authority have determined that the Authority is the appropriate body to oversee the rehabilitation of the Tivoli Building and to ensure rehabilitation of the Tivoli Building in compliance with the provisions of the Eastgate- Westgate Urban Renewal Plan. E. The Cooperation Agreement between the City and the Authority, attached hereto as Exhibit A, will advance the public health, safety, morals and welfare of the residents of the City and will serve a public purpose of the City. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of University City, Missouri as follows: t. The Cooperation Agreement is hereby approved and the Mayor and the members of the City Council are hereby authorized to execute same on behalf of the City and to take all actions including, without limitation, a loan of funds and the execution of all notes, Certificates, or other documents, necessary to effectuate the terms of the Cooperation Agreement. 2. The portions of this Ordinance shall be severable. In the event that any portion of this Ordinance is found by a court of competent jurisdiction to be invalid, the remaining portions of this Ordinance are valid, unless the court finds the valid portions of this Ordinance are so essential and inseparably
