BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER THOMPSON <br /> <br />8203 ORDINANCE NO. 5988 <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY <br />OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING SECTION 34-9e <br />THEREOF, RELATING TO DEFINITIONS, AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS "SECTION 34-9~1. DEFINITIONS," BY ADDING <br />DEFINITIONS OF "ABUTTING" AND "ZONING LOT"I CONTAINING A SAVING <br />CLAUSE AND PROVIDING A PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of University City <br />(University City Zoning Code) divides the City into several zoning districts, and <br />regulates the uses to which the premises located therein may be pull and <br /> <br /> WHEREAS, the City Plan Commission in a meeting held at the City Hall on <br />October 31, 1994, at 7:3e p.m. recommended an amendment of Section 34-40.3 of the <br />University City Zoning Code by adding "outdoor bus parking facility" to Section <br />34-40.3, resulting in the addition of the terms "Abutting" and "Zoning Lot" in <br />the zoning code; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City Council in <br />the City Council Chambers at City Hall at 7:30 p.m. on the 7th day of November, <br />1994, was duly published in the Watchman Advocate, a newspaper of general <br />circulation within said City on October 20, 1994; and <br /> <br /> V~EREAS, said public hearing was duly held at the time and place specified <br />in said notice, and all suggestions or objections concerning such change in said <br />section were duly heard and considered by the Council. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 34 of the Municipal Code of the City of University <br />City, MIssouri, relating to Zoning is hereby amended by repealing Section 34-9~ <br />thereof, relating to "Definitions", and enacting in lieu thereof a new section <br />to be known as "Section 34-90, Definitions," relating to the same subject, and <br />re-enacting said section so that said section as so amended, shalt read as <br />follows: <br /> <br />SECTION 34-9e. DEFINITIONS. <br /> <br />Abutting: Having a common border with, or being Separated from such <br />a common border by a right of way or easement for a street, alley, <br />pedestrian way, utilities, or Storm water drainage. <br /> <br />Accessory Use (Structure): See Section 34-52.2 <br /> <br />Apartment DWelling: A building or portion thereof, designed for <br />occupancy by three (3) or more families living independently of each <br />other, exclusive of attached single-family dwellings, townhouses, or <br />patio houses or individually subdivided lots. <br /> <br />Attached Single-Family DWelling: One (1) of a series of attached <br />dwetling units located on individual subdivided lots of record. <br /> <br />Automobile Filling Station: A use solely for the retail sale and <br />dispensing of gasoline, oil, air and water. <br /> <br /> <br />
