Property is used for the uses permitted in the Urban Renewal <br />Plan, the Redevelopment Proposal and in this Agreement as now or <br />hereafter from time to time amended all as provided for by <br />Ordinance 5900 of the City of University City, Missouri. In no <br />event shall the partial tax relief and abatement conferred exceed <br />twenty (20) years starting with the date of the first year of <br />such tax relief and with respect to the Property, regardless or <br />ownership or transfer. <br /> <br /> (g) Nothing contained herein shall constitute the <br />Authority's representation or warranty as to the availability or <br />applicability of tax abatement under the provisions of Section <br />353.110 R.S.Mo., 1986, as amended, and the Authority shall in no <br />event be liable to the Redeveloper or any other party claiming by <br />or through the Redeveloper do to the failure of the benefits of <br />such tax abatement to be deemed applicable to the Property. <br /> <br /> (h) Notwithstanding the foregoing provisions of <br />Paragraph 8 hereof, the parties further agree, understand and <br />intend that any rights which Redeveloper, its heirs, successors <br />or assigns may now or hereafter acquire under Section 353.110 <br />R.S.Mo. 1986, as now or hereafter amended, are expressly limited <br />by this Paragraph and all subsections hereof. Redeveloper <br />expressly waives any and all rights it may have to claim any <br />exemption from the payment of general ad valorem taxes upon the <br />Property pursuant to Section 353,110 R.S.Mo., for periods of time <br />or for amounts beyond the period and amounts detailed in this <br />paragraph.
