BILL NO. <br /> <br />820'/ <br /> <br />INTRODUCED BY COUNCILMEMBER COTTON <br /> <br /> ORDINANCE NO. <br /> <br />5992 <br /> <br />AN ORDINANCE AMENDING CHAPTER 23 OF THE MUNICIPAL CODE OF THE CITY <br />OF UNIVERSITY CITY, RELATING TO OFFENSES-MISCELLANEOUS, AND ENACTING <br />THEREIN A NEW SECTION TO BE KNOWN AS "SECTION 23-57, ENDANGERING <br />THEWELFARE OF A CHILD~ CONTAINING A SAVING CLAUSE AND PROVIDING A <br />PENALTY. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS <br />FOLLOWS: <br /> <br /> Section 1. Chapter 23 of the Municipal Code of the City of University <br />City, relating 1o Offenses-Miscellaneous, is hereby amended by enacting therein <br />a new section to be known as "Section 23-57. Endangering the Welfare of a <br />Child;" reading as follows: <br /> <br />23-57. ENDANGERING THE V~LFARE OF A CHILD. <br /> <br />A person commits the ordinance violation of endangering the welfare <br />of a child if: <br /> <br />He acts in a manner that creates a substantial risk to the <br />life, body or health of a child less than seventeen years old; <br />or <br /> <br />(2, <br /> <br />He encourages, aids or causes a child less than seventeen <br />years old to engage in any conduct which causes or tends to <br />cause the child to come within the provisions of subdivision <br />(2) of subsection 1 or subdivision (3) of subsection 1 of <br />section 211.031, R~o; or <br /> <br />(3) <br /> <br />Being a parent, guardian or other person legally charged with <br />the care or custody of a child less than seventeen years old. <br />he fails or refuses to exercise reasonable diligence in the <br />care or control of such child to prevent him from coming <br />within the provisions of paragraph (c) of subdivision (1) of <br />subsection 1 or subdivision (2) of subsection 1 or subdivision <br />(3) of subsection 1 of section 211.031, RSMo; or <br /> <br />(4) <br /> <br />He encourages, aids or causes a child less than seventeen <br />years old to enter into any room, building or other structure <br />which ~s a public nuisance as defined in section 195.130, <br />R~o. <br /> <br />For purposes of this section, a parent, guardian or other person <br />legally charged with the care or custody of a child less than <br />seventeen years old shall have the duty to exercise reasonable care, <br />supervision, protection and control over the child. <br /> <br /> <br />
