BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER SCHUMAN <br /> <br />8227 ORDINANCE NO. 6011 <br /> <br />AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY <br />OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING SECTION 34-36.4 <br />THEREOF, RELATING TO CONDITIONAL USES IN THE RC - RETAIL COMMERCIAL <br />DISTRICT, A/~D ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWq~ AS <br />"SECTION 34-36.4 CONDITIONAL USES," BY ADDING PARKING LOTS AND <br />PARKING STRUCTURES; CONTAINING A SAVING CLAUSE AND PROVIDING A <br />PENALTY. <br /> <br /> WHEREAS, Chapter 34 of the Municipal Code of the City of University City <br />(University City Zoning Code) divides the City into several zoning districts, and <br />regulates the uses to which the premises located therein may be put; and <br /> <br /> WHEREAS, Section 34-36.4 provides for "Conditional Uses" in "RC" - Retail <br />Commercial District; and <br /> <br /> WHEREAS, the City Plan Commission in a meeting held at the City Hall on <br />January 25, 1995, at 7:30 p.m. recommended an amendment of Section 34-36.4 of the <br />University City Zoning Code by adding "Parking lots and parking structures as a <br />principal use, provided the use does not include the storage of wrecked, damaged <br />or inoperable vehicles" as a conditional use in the "RC" - Retail Commercial <br />District to Section 34-36.4; and <br /> <br /> WHEREAS, due notice of a public hearing to be held by the City Council in <br />the City Council Chan~bers at City Hall at 7:30 p.m., February 27, 1995, was duly <br />published in the Watchman-Advocate, a newspaper of general circulation within <br />said City on February 10, 1995; and <br /> <br /> WHEREAS, said public hearing was held at the time and place specified in <br />said notice, and all suggestions or objections concerning said amendment were <br />duly heard and considered by the Council; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY <br />CITY, MISSOURI, AS FOLLOWS: <br /> <br /> Section 1. Chapter 34 of the Municipal Code of the City of University <br />City, Missouri, relating to zoning is hereby amended by repealing Section 34- <br />36.4, relating to conditional uses in the "RC" - Retail Commercial District, and <br />enacting in lieu thereof a new section to be known as "Section 34-36.4 <br />Conditional Uses," relating to the same subject, and re-enacting said section so <br />that said section, as so amended, shall read as follows: <br /> <br />34-36.4 Conditional uses. <br /> <br />The Council, by conditional use permit, as provided in Section 34- <br />65, after public hearing before the Plan Commission and subject to <br />such protective restrictions and conditions that the Council may <br />deem necessary, may authorize any of the following uses: <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />6. <br /> <br />7. <br /> <br />Automobile filling stations or service stations. <br />Churches, synagogues and related facilities. <br />Drive-in facilities of any type. <br /> <br />Drive-in restaurants or carry-out restaurants. <br />Mortuary. <br /> <br />Motor vehicle repair or washing. <br /> <br />Outdoor commercial amusements. <br /> <br /> <br />
