BILL NO. INTRODUCED BY COUNCILMEMBER SCHUMAN 8227 ORDINANCE NO. 6011 AN ORDINANCE AMENDING CHAPTER 34 OF THE MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY RELATING TO ZONING BY REPEALING SECTION 34-36.4 THEREOF, RELATING TO CONDITIONAL USES IN THE RC - RETAIL COMMERCIAL DISTRICT, A/~D ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWq~ AS "SECTION 34-36.4 CONDITIONAL USES," BY ADDING PARKING LOTS AND PARKING STRUCTURES; CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY. WHEREAS, Chapter 34 of the Municipal Code of the City of University City (University City Zoning Code) divides the City into several zoning districts, and regulates the uses to which the premises located therein may be put; and WHEREAS, Section 34-36.4 provides for "Conditional Uses" in "RC" - Retail Commercial District; and WHEREAS, the City Plan Commission in a meeting held at the City Hall on January 25, 1995, at 7:30 p.m. recommended an amendment of Section 34-36.4 of the University City Zoning Code by adding "Parking lots and parking structures as a principal use, provided the use does not include the storage of wrecked, damaged or inoperable vehicles" as a conditional use in the "RC" - Retail Commercial District to Section 34-36.4; and WHEREAS, due notice of a public hearing to be held by the City Council in the City Council Chan~bers at City Hall at 7:30 p.m., February 27, 1995, was duly published in the Watchman-Advocate, a newspaper of general circulation within said City on February 10, 1995; and WHEREAS, said public hearing was held at the time and place specified in said notice, and all suggestions or objections concerning said amendment were duly heard and considered by the Council; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 34 of the Municipal Code of the City of University City, Missouri, relating to zoning is hereby amended by repealing Section 34- 36.4, relating to conditional uses in the "RC" - Retail Commercial District, and enacting in lieu thereof a new section to be known as "Section 34-36.4 Conditional Uses," relating to the same subject, and re-enacting said section so that said section, as so amended, shall read as follows: 34-36.4 Conditional uses. The Council, by conditional use permit, as provided in Section 34- 65, after public hearing before the Plan Commission and subject to such protective restrictions and conditions that the Council may deem necessary, may authorize any of the following uses: 2. 3. 4. 5. 6. 7.
