BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER ADAMS <br /> <br />8243 OPDINANCE NO. 6027 <br /> <br />AN ORDINANCE AMENDING CHAPTER 25 OF THE MUNICIPAL CODE OF <br />THE CITY OF UNIVERSIW CITY, RELATING TO RETIREMENT AND PENSIONS, <br />BY REPEALING SECTION 25-18 AND ENACTING IN LIEU THEREOF A NEW <br />SECTION TO BE KNOWN AS "SECTION 25-18. SAME-ADJUSTMENTS FOR <br />COMPENSATION UNDER WORKERS' COMPENSATION LAW." <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, <br />AS FOLLOWS: <br /> <br /> Section 1. Chapter 25 of the Municipal Code of the City of University City, <br />relating to retirement and pensions, is hereby amended by repealing Section 25-18 <br />and enacting in lieu thereof a new section to be known as "Section 25-18. Same- <br />Adjustments for Compensation Under Workers' Compensation Law;" so that said <br />section, as so amended, shall read as follows: <br /> <br />Section 25-18. <br /> <br />Same-Adjustments for Compensation <br />Workers Compensation Law. <br /> <br />Under <br /> <br />If an employee or his/her dependents are entitled to benefits under <br />this article and likewise to benefits under the Workers' Compensation <br />law as a result of the same injury, the benefits payable under this <br />article shall, to the extent permitted by applicable law, be reduced <br />in the manner prescribed by the statutes of the state of Missouri, and <br />if there is no applicable statute, then the benefits shall be adjusted in <br />accordance with the next succeeding paragraph. <br /> <br />The amount of benefit under this adicle shall be reduced by the <br />amount of monthly income paid under the Workers' Compensation <br />law or attributed to the Workers' Compensation law except that the <br />benefit under this article shall not be less than the benefit determined <br />in Section 25-21 multiplied by the ratio of the total contributions of the <br />employees in the preceding fiscal year to the total contributions of <br />the City and the employees in the preceding fiscal year. The Board <br />of Trustees shall have full right to apply the provisions of the plan in <br />such equitable manner as it determines. <br /> <br />Workers' Compensation benefits payable for reimbursement of <br />medical expenses or medically related expenses shall not be <br />considered herein. Where monthly income benefits under the <br />Workers' Compensation law are converted to lump sum payments, <br />the amount of monthly income attributed to such lump sum payment <br />shall be the amount of monthly lifetime income which can be <br /> <br /> <br />
