within a reasonable period not to exceed 30 days and (b) such <br /> breach is not a recurring breach with respect to which prior <br /> notice or notices have been given, then (i) the UCRC, in the <br /> event of breach by Developer, shall give written notice of such <br /> breach to the breaching party, stating the nature of the breach, <br /> and (ii) the UCRC will afford the Developer thirty (30) days to <br /> cure the breach, provided if such breach cannot, with due <br /> diligence, be cured within thirty (30) days, the UCRC will afford <br /> the Developer a reasonable period to cure the breach so long as <br /> such cure is promptly undertaken and diligently pursued. <br /> <br /> 4. Waiver of Default. No waiver of any default shall be <br />implied from any omission by the UCRC to take any action on <br />account of such default if such default persists or is repeated, <br />and no express waiver shall affect any default other than the <br />default specified in the express waiver and then only for the <br />term and to the extent therein stated. One or more waivers by <br />the UCRC of a breach of any covenant, term or condition of this <br />Agreement shall not be construed as a waiver of any subsequent <br />breach of the same or any other covenant, term or condition. The <br />consent or approval by the UCRC to or of any act by Developer <br />requiring the UCRC's approval or consent shall not be deemed to <br />waive or render unnecessary the UCRC's consent or approval to or <br />of any subsequent similar acts by Developer. <br /> <br /> 5. Inspection and Access.
