<br />AN ORDINANCE RENEWING AN F_XISTING FRANCHISE AND GRANTING FOR A PERIOD
<br />OF TEN (10) YEARS TO LACLEDE GAS COMPANY, A MISSOURI CORPORATION, ITS
<br />SUCCESSORS AND ASSIGNS, THE RIGHT, PERMISSION AND AUTHORITY TO
<br />CONSTRUCT, RECONSTRUCT, EXCAVATE FOR, PLACE, MAINTAIN, OPERATE AND USE
<br />ITS MAINS, SERVICE PIPES, CONDUCTORS AND OTHER EQUIPMENT, WITH ALL
<br />NECESSARY OR APPROPRIATE APPURTENANCES AND APPLIANCES IN CONNECTION
<br />THEREWITH, IN, ALONG, ACROSS, OVER AND UNDER THE STREETS, ROADS, ALLEYS,
<br />SIDEWALKS, SQUARES, BRIDGES, AND OTHER PUBLIC PLACES IN THE CITY OF
<br />UNIVERSITY CITY, FOR THE PURPOSE OF TRANSMI~ING, FURNISHING, TRANSPORTING
<br />AND DISTRIBUTING GAS FOR LIGHT, HEAT, POWER AND OTHER PURPOSES WITHIN AND
<br />THROUGH THE CITY OF UNIVERSITY CITY, PRESCRIBING THE TERMS AND CONDITIONS
<br />OF SUCH GRANT, PROVIDI[XlG FOR NON-DISCRIMINATION AGAINST EMPLOYEE OR
<br />APPUCANT, IMPOSING CERTAIN OBLIGATIONS UPON THE GRANTEE, ITS SUCCESSORS
<br />AND ASSIGNS, SUCCESSIVELY, IN CONNECTION THEREWITH AND PROVIDING THAT
<br />THIS ORDINANCE SHALL NOT BE EFFECTIVE UNLESS LACLEDE GAS COMPANY SHALL,
<br />WITHIN SIXTY (60) DAYS AFTER THE ENACTMENT OF THIS ORDINANCE, FILE WITH THE
<br />CITY AN ACCEPTANCE OF THIS ORDINANCE.

<br /> WHEREAS, Ordinance No. 6006, renewing a franchise with Laclede Gas, was lawfully
<br />passed on April 10, 1995; and
<br />
<br /> WHEREAS, Ordinance No. 6006 requires Laclede Gas to file its acceptance within 60 days
<br />after due notice of the passage; and
<br />
<br /> WHEREAS, Upon further consideration, Laclede Gas is willing to accept the terms and
<br />provisions of Ordinance No. 6006, provided the following language in Section 1 of Ordinance
<br />No. 6006 is deleted: "and the City reserves the right to amend this ordinance accordingly"; and
<br />
<br /> WHEREAS, the City of University City is willing to delete said language as requested by
<br />Laclede Gas.

<br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY,
<br />MISSOURI, AS FOLLOWS:
<br />
<br /> Section 1. The right, permission and authority is hereby granted to, renewed, and vested
<br />in, Laclede Gas Company, a corporation of the State of Missouri (hereinafter sometimes called
<br />"Laclede"), its successors and assigns, to construct, reconstruct, excavate for, place, maintain,
<br />operate and use all necessary or appropriate 'mains, service pipes, conduits, conductors,
<br />underground vaults and other equipment with all necessary or appropriate appurtenances and
<br />appliances in connection therewith, in, along, across, over and under the streets, roads, alleys,
<br />sidewalks, squares, bridges and other public ways and places within the corporate limits of the
<br />City of University City, hereinafter called the "City", as now fixed and as hereafter extended, for
<br />the purpose of transmifling, furnishing, transporting, and distributing gas for light, heat, power
<br />and other purposes within the City and in territory adjacent to said City and for the purpose of
<br />transmiHing and transporting gas through said City; all such equipment, appliances and
<br />apparatus to be installed and maintained with due regard to the rightful use by other persons,
