BILL NO. <br /> <br /> INTRODUCED BY COUNCILMEMBER SCHOOMER <br /> <br />8262 ORDINANCE NO, 6045 <br /> <br />AN ORDINANCE GRANTING A ONE-YEAR EXTENSION OF THE CURRENT <br />FRANCHISE TO CONTINENTAL CABLEVISION OF ST. LOUIS COUNTY, INC., <br />SO THAT CONTINENTAL CABLEVISION OF ST. LOUIS COUNTY, INC., MAY <br />CONTINUE TO OPERATE AND MAINTAIN A CABLE TELEVISION SYSTEM IN THE <br />CITY OF UNIVERSITY CITY, MISSOURI, AND SEITING FORTH CONDITIONS <br />ACCOMPANYING THE GRANTING OF THE FRANCHISE EXTENSION AND <br />CONTAINING AN EMERGENCY CLAUSE. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS <br />FOLLOWS: <br /> <br />SECTION 1. GRANT OF EXTENSION: TERM <br /> <br /> The City of University City, Missouri; (hereinafter also referred to and known as <br />"Grantor") hereby grants to Continental Cablevision of St. Louis County, Inc. <br />(hereinafter referred to and known as "Grantees), an extension of its current cable <br />television franchise, being Ordinance No. 5272, for a period from January 5, 1996, to <br />and including January 5, 1997. <br /> <br />SECTION 2. TERMS AND CONDITIONS - NO WAIVER OF RIGHTS <br /> <br /> The terms and conditions of the grant extension shall be the same as the terms <br />and conditions set out in Ordinance No. 5272. However, nothing in this extension shall <br />be deemed to cause any waiver by either Grantor or Grantee of any rights they have <br />under all applicable laws, including Ordinance No. 5272. Further, the expiration date <br />of Ordinance No. 5272 shall be deemed January 5, 1997, for all purposes. <br /> <br />SECTION 3. SEVERABiLITY <br /> <br /> If any section, subsection, sentence, clause, phrase or portion of this Ordinance <br />is for any reason held invalid or unconstitutional by any court of competent <br />jurisdiction, such portion shall be deemed a separate, distinct and independent <br />provision and such holding shall not affect the validity of the remaining portions <br />hereof. <br /> <br />SECTION 4. EMERGENCY CLAUSE: EFFECTIVE DATE <br /> <br /> An emergency is hereby declared to exist in that the existing franchise, <br />Ordinance No. 5272, has expired on January 5, 1996, and passage and approval of <br />this Ordinance is necessary for the continued provision of cable services to University <br />City subscribers. This ordinance shall take effect and be in full force and effect from <br />and after its passage as provided by law. <br /> <br />PASSED this 8th day of January , 1996. <br /> <br /> <br />
