~ROM:OMNI~AX TO: J14 86~ 91~6 SAN 19~ 1996 l:11PM ~999 P.0] <br /> <br /> ~NTRODUCED BY COU~CILMEMBER SCHOOMER <br /> <br />BILL NO. 8267 ORDINANCE NO. 6050 <br /> <br /> AN ORDINANCE ESTABLISHING THE PARKVIEW GARDENS <br /> SPECIAL BUSINESS DISTRICT; SUBJECTING REAL PROPERTY <br /> LOCATED IN THE PARKVIEW GARDENS SPECIAL BUSINESS DISTRICT <br /> TO AN INITIAL RATE OF LEVY, SUBJECT TO VOTER APPROVAL; <br /> SPECIFYING THE USES TO WHICH THE ADDITIONAL REVENUE SHALL BE <br /> PUT; CREATING AN ADVISORY COMMISSION AND RNUMERATING THE DUTIES <br /> AND RESPONSIBILITIES OF SAID COMMISSION; CALLING FOR AN <br /> ELECTION TO SUBMIT THE QUESTION OF THE TAX LEVY TO BE <br />IMPOSED TO T~E QUALIFIED VOTERS OF THE PARKVIEW GARDENS SPECIAL <br />BUSINESS DIBTRICT; AUTHORIZING THE CITY MANAGER TO TAKE_~]~cH <br />FURTHER ACTIONS AS ARE NECESSARY OR CONVENIENT TO EFFECTUATE THE <br />TNTENT OF THIS ORDINANCE; AND CONTAINING A SEVERABILITY CLAUS~ <br /> <br /> WHEREAS, the City of University City (the "City") has <br />received a petition pursuant to sections 71.790 through 71.808 of <br />Missouri Revised Statutes 1994, as amended (the "Special Business <br />District Act") to establish a Parkview Gardens Special Business <br />District which was submitted by owners of real property on which <br />is paid the ad valorem real property taxes within the proposed <br />district; and <br /> <br /> WHEREAS, the City conducted a survey and investigation for <br />the purposes of determining the nature of and suitable location <br />for business district improvements, the approximate cost of <br />acquiring and improving the land therefor, the area to be <br />included in the proposed district, the need for and cost of <br />special services, and cooperative promotion activities, and the <br />percentage of the cost of acquisition, special services, and <br />improvements within the business district and that part of the <br />cost, if any, to be paid by public funds (the "Survey and <br />Investigation") and filed a written report of the Survey and <br />Investigation Jn the office of the City Clerk; and <br /> <br /> WHEREAM, cn January 9, 1996 the City Council, by Resolution <br />J~- __, adopted a Resolution of Intent to Establish a Parkview <br /> Gardens Special Business District having a boundary as described <br /> in the Survey and Investigation (the District") and on January <br /> 22, 1996 held a public hearing duly noticed by publication and <br /> mailing to consider the establishment of the District (the <br /> "Hearing") and heard and ruled on all protests and received <br /> evidence for or against the proposed action; and <br /> <br /> WHEREAS, following the Hearing, the City Council wishes to <br />establish the District in accordance with the requirements of the <br />Special Busines, District Act; <br /> <br />STL-38?Z66 <br /> <br /> <br />
