FROM:OMNIFAX TO: 314 863 9146 JAN 19, 1996 I:I~PM ~999 P.05 <br /> <br />Gardens Special Business District. The Commission shall have the <br />following duties and responsibilities only: <br /> <br /> (a) To make recommendations to the City Council as to the <br />use of revenue from any tax imposed within the Parkview Gardens <br />Special Business District under the Special Business District <br />Act; and <br /> <br /> (b) To undertake such other tasks, duties, and <br />responsibilities as the City Council shall from time to time <br />desi9nate. <br /> <br /> The terms of members first appointed shall be staggered as <br />follows: ..om~ members shall be designated to serve a term of one <br /> (1) year; +~o members shall be designated to serve a term of two <br /> (2) years; .~L0_- members shall be designated to serve a term of <br />three (3) years. Subsequent terms shall be for three (3) years. <br />Appointments to fill vacancies shall be for the unexpired portion <br />of a term only. The Commission shall annually elect a <br />Chairperson, Vxce Chairperson, and Secretary and shall adopt such <br />rules or bylaws as shall the Commission shall deem necessary or <br />convenient to carry out the duties and responsibilities under <br />this section. <br /> <br /> Section 6,. There is hereby ordered an election on the <br />question of the imposition of the initial tax levy provided in <br />this Ordinance to be submitted to the qualified voters of the <br />Parkview Gardens Special Business District. The City Manager is <br />hereby authorized and directed to take such further action as may <br />be necessary oz convenient to place or cause to be placed the <br />question of the initial tax levy before the qualified voters of <br />the Parkview Gardens Special Business District at the earliest <br />practicable date and as provided by law. <br /> <br /> Section 7. The City Manager is hereby further authorized <br />to take such further actions as may be necessary or convenient to <br />implement or to effectuate the intent of this Ordinance. <br /> <br /> SeC~iO~ 8. The sections of this Ordinance shall be <br />severable. In the event that any section of this Ordinance is <br />found by a cour"~ of competenU jurisdiction to be invalid or <br />unconstitutional, the remaining sections of this Ordinance shall <br />remain valid, unless the court finds that the valid sections of <br />this Ordinance are so essentially and inseparably connected with <br />and so dependen~ upon the void section, that it cannot be <br />presumed that the City Council would have enacted the valid <br />sections without. the void sections; or unless the court finds <br />that the valid sections standing alone are incomplete and are <br />incapable of being executed in accordance with the legislative <br />intent. <br /> <br />$ T L ~ 3877.~ <br /> <br /> <br />
