(2) Upon request, copies of the materials specified in the preceding subsection <br />shall be provided to the City. Franchisee shall provide all Subscribers and the City at least thirty (30) <br />days' notice of any significant changes in the information required by this section, provided if such <br />changes are not within the Franchisee's control then it shall provide such notice as is reasonably <br />possible. Such notice shall be in writing or by announcement on the System. Franchisee may provide <br />notice of service and rate changes to Subscribers using any reasonable written means at its sole <br />discretion. Franchisee need not provide prior notice of any rate change that is the result of a <br />regulatory fee, franchise fee, or any other fee, tax, assessment, or charge of any kind imposed by any <br />Federal agency, State, or franchising authority on the transaction between the Franchisee and the <br />subscriber. <br /> <br /> (3) All Franchisee promotional materials, announcements, and advertising of <br />residential Cable Service to Subscribers and the general public, where price information is listed in <br />any manner, shall clearly and accurately disclose price terms. In the case of pay-per-view or pay-per- <br />event programming, all promotional materials must clearly and accurately disclose price terms and <br />in the case of telephone orders, a Franchisee shall take appropriate steps to ensure that the customer <br />service representatives clearly and accurately disclose price terms to potential customers in advance <br />of taking the order. <br /> <br /> (4) Each Franchisee shall maintain a public file containing all notices provided to <br />Subscribers under these customer service standards, as well as all written promotional offers made <br />to Subscribers. <br /> <br />e. Interruptions qf Service. <br /> <br /> A Franchisee may intentionally interrupt service on the Cable System only for good cause and <br />for the shortest time possible and, except in emergency situations, only after a minimum of forty-eight <br />(48) hours' prior notice to Subscribers and the City of the anticipated Service Interruption; provided, <br />however, that planned maintenance that occurs between the hours of 12:00 midnight and 6:00 a.m. <br />shall not require such notice to Subscribers, so long as notice to the City is given prior to such an <br />anticipated Service Interruption. <br /> <br />f. Billing. <br /> <br /> (1) A Franchisee's first billing statement after a new installation or service change <br />shall be prorated as appropriate and shall reflect any security deposit. <br /> <br /> (2) A Franchisee's billing statement must be clear, concise and understandable, <br />must itemize each category of service and equipment provided to the Subscriber and must clearly <br />delineate the charge therefor. <br /> <br /> (3) A Franchisee's billing statement must be mailed on or before the first ( 1 st) day <br />of the month (or equivalent period) and show a specific payment due date not earlier than the tenth <br />(10th) day of the month (or equivalent period) in which the service being billed is rendered.
