(30) days before such Premium Channel is provided without charge, notify all Subscribers by any <br />reasonable means at its sole discretion of its plans including the time period involved, notify all <br />Subscribers they have a fight to request that the Premium Channel be blocked, and block the Premium <br />Channel upon the request of a Subscriber; provided if such change in Premium Channel availability <br />is not within the control of the Franchisee, then it shall give such notice as is reasonably possible. <br />For purposes of this section, the phrase "Premium Channel" shall mean any pay service offered on <br />a per channel or per program basis which offers movies rated by the Motion Picture Association of <br />America as X, NC-17, or R. <br /> <br />i. Deposits. <br /> <br /> A Franchisee may require a reasonable, non-discriminatory deposit on equipment provided <br />to Subscribers. The Franchisee shall return the deposit upon return of the equipment, less any <br />deduction for damages to the equipment or unpaid charges. <br /> <br />j. Subscriber Control. <br /> <br /> A Franchisee shall comply with all applicable laws regarding Subscriber ability to block <br />audio and/or video signals. <br /> <br />k. Violations. <br /> <br /> For violation of provisions of these regulations, subject to judicial procedures, <br />penalties shall be chargeable to the Franchisee at the rate of $100.00 per violation for each day the <br />violation continues after the Franchisee has notice of the violation and a reasonable opportunity to <br />cure it. <br /> <br /> <br />
