SECTION 24, OF THE <br />MUNICIPAL CODE OF THE CITY OF UNIVERSITY CITY, RELATING <br />TO RETIREMENT AND PENSIONS AS AMENDED BY ORDINANCE <br />NO. 5058 ENACTED AUGUST 28, 1977, IS HEREBY AMENDED BY <br />CHANGING THE FIRST PARAGRAPH THEREOF RELATING TO <br />REINSTATEMENT OF FORMERLY DISABLED PENSION <br />BENEFICIARIES INTO ACTIVE SERVICE. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br />MISSOURI, AS FOLLOWS: <br /> <br /> Chapter 25, Section 24, of the Municipal Code of the City of University City relating <br />to retirement and pensions as amended by Ordinance No. 5058 enacted August 29, 1977, is <br />hereby amended by changing the first paragraph thereof relating to employment of pension <br />beneficiaries into active service and by adding a third paragraph which provides that <br />disability benefits ~nay be terminated if a pension beneficiary is offered certain alternative <br />employment with the city, which the pension beneficiary is deemed capable of performing, <br />so that said section as so amended shall read as follows: <br /> <br />Section 25.24. Same--Physical examinations required; Adjustment or termination of <br />benefits. <br /> The Board of Trustees shall have the fight to require every person receiving disability <br /> benefits under this Article, prior to attaining age fifty-five (55), to undergo a <br /> physical examination by the physician or medical board designated by the Board of <br /> Trustees at such reasonable times as the Board shall deem necessary. Should any <br /> such examination disclose that the person is able to resume his/her employment as a <br /> policeman or firefighter, the right of such person to further benefits hereunder shall <br /> terminate, and such person refusing to submit to any such examination shall receive <br /> .no further disability benefits pending submission to such examination. If such refusal <br /> continues for a period of one (I) year, all rights of such person to disability benefits <br /> under this Amcle shall terminate. In the event any person receiving disability benefits <br /> should subsequently be found to have recovered from such disability, then the Board <br /> of Trustees shall notify the personnel director of the City in writing of the fact and <br /> that such person is eligible to be restored to her/his former active service, provided <br /> such position still exists, and such person is then qualified in the same respect as <br /> required by standards then currently in effect for continued employment in the <br /> position as may from time to time be adopted by the City or its Department, and <br /> provided a bona fide opening exists. Upon such finding, subject to said conditions, <br /> the personn61 director shall restore such person to their former position with their <br /> previous date of rank and longevity as of the last date of such person's prior active <br /> duty. <br /> <br /> <br />
